    Need some legal advice

    Long story short- we purchased a used dirt bike from a dealer that promised us it had all been gone through and checked out, nothing was wrong at all ready to ride etc ... throttle gets stuck and brakes failed now my son has some serious injuries Christmas morning.

    What do I do here? They lied and this day is ruined [emoji35]

            He’s got road rash on arms and legs really bad the bike had blood all over it. Luckily he had a helmet on and no broken bones. Sucks that a 9 year old has to spend Christmas like this because a grown man lied to us to make a lousy $999 sale

              Used is “as is” unless in writing. Sorry for your son’s injuries, but you’ll need to teach him how to pull in the clutch and hit the kill switch.

              BTW, I have seen LOTS of new riders get nervous on bikes and gokarts. They will pin/floor the throttle and mash the brake at the same time. Brake can’t stop them.

              Watched my son do it on a mini bike, and watched a friend’s kid do it on a gokart (and **** near run under a truck, in an old style gokart with no rollbar

                Man, prayers up for your son. Hope he bounces back quickly. I’m short, you are in a better position legally since purchased from a dealer than an individual but still may be difficult to prevail.

                  Prayers for your sons health sent up !! Sadly I don’t think you have recourse. It’s the chance you take buying used. I got burned 8k worth on a BMW a couple of years ago and 4K on a Honda Civic this year. Never again !
