Let me preface this with, just because I am asking if this situation is legal does not mean that I would take this shot. In fact, this season I passed on a shot of the biggest deer I have ever seen because of the legal and ethical question here.
A property that I hunt borders the Lampasas River in central Texas. The river in this area sits in a valley with two large cliff faces on either side and sandy banks on either side of the water. Some years there is a lot of water in it and it would be impassable and others the water is low and could be easily walked across. This year the water has been low and the deer that I spotted was traveling along the bank of my property but then eventually crossed the river onto the neighboring property.
Out of curiosity, is it legal to shoot a deer on my side of the bank and illegal to shoot a deer on the neighboring side, or is it legal to shoot as long as the deer is within the riverbank? Is it legal to shoot if a deer is standing in the middle of the water, what is the law here?
