I told him I thought it was a scam but was able to verify that the ATF will call you and that he had a hit pop up from a case in 1995, when he was 17.
He took the gun back and has a lawyer now trying to figure out what the deal is.
Hmmmm, I’d be very skeptical of that one. I’d expect an agent to show up for something like that. I believe I would have requested one.

I have had a customer get a deny when he always got proceeds before & called out the examiner to the fact...they said they would call right back & they did apologizing profusely. NICS uses 3 computers to cross reference & if you have a common name with some thug, you can expect a delay & in this case mistaken identity with a deny. This why getting your carry permit or even a NICS UPIN (unique personal identification number) to put on the 4473 will avoid these issues.

I was too, I'm LE and called one of our detectives (who was skeptical as well) who called an ATF agent directly and asked him if they call people on the phone. He said yes they do and advised my friend to follow the instructions he was given lol.
I'll check in with him today and see if he has an update.
In for the rest of this story. Let us know what happened in 95

Yikes!! A call from the BAFTE would suck. I had a friend have a two BAFTE Agents show up at his house inquiring about his purchases and tax stamps. He told the agents to remain outside on the porch. Buddy went in and got his "portfolio" as he calls it and presented it to the Agents. One of the Agents asked if he could see the NFA items, buddy told them they were not entering his house without a warrant and that the upkeep of paperwork and tax stamps should suffice. They Thanked him for his cooperation and handed him back his portfolio and left, never heard another thing out of them.

Kudos to Academy
If your "friend" can't read and answer a few simple question, he has no reason buying a gun.
Originally posted by ultrastealth View PostHe is a resident alien, and, knowing some of the clerks at Academy (there are some good ones too, not trashing all Academy employees) he may very well have filled it out correctly, and they didn't know that a resident alien can legally purchase a firearm. The thing that really irks me is not telling him what he did wrong. For those of you who said that he should buy it somewhere else, good luck finding a Hellcat at a local shop in stock for MSRP or less. There's a shop on my way to work that is asking $100 over MSRP. I like to patronize small businesses, but I won't let them steal me blind. I found the gun at Academy for him, and I didn't see it available anywhere else.
Originally posted by ultrastealth View PostAdd to that that no criminal is going to care about lying on that form and that a very few convicted felons get prosecuted for trying to buy a gun illegally, even though they have the form they signed as evidence. Gun laws are for the law-abiding only.

Also, don't play the immigrant/race card. Looks petty. If you want the $100 off, play by the stores rules or else go buy it for more elsewhere.
Agree that no criminal is going to care about lying but that doesn't mean we should give a road map to them.

It’s not academy’s fault to know what answer is right or wrong for a specific individual. It’s the individuals responsibility to fill it out right and truthfully. The answer he gave wasn’t wrong, it just wasn’t compliant with a PASS
“Oh hey mr illegal alien felon, you can’t buy this gun unless you mark these answers like this, which may not be true to you...”.

Some of you guys need to get off your high horse...HIs friend bought the gun somewhere else & their brazen policy cost them a sale & future customer. I've been an ffl since 07 & every inspecting agent has told me they have NEVER had an audit that has significant volume without finding a mistake of some sort & that is all on me whether I missed or something from the buyer overlooked. They do not care about the small stuff like a missed check off from either the buyer or ffl if there is a nics approval or LTC listed. Their concerns are about FFL's being indifferent & seeing carelessness being rampant where traceability / Straws / etc. type concerns come into play.
12.d.1. ARE YOU AN ALIEN WHO HAS BEEN ADMITTED TO THE U.S. UNDER AN IMMIGRANT VISA? YES NO
12.d.2. IF 'YES' DO YOU FALL WITHIN ANY OF THE EXCEPTIONS STATED IN THE INSTRUCTIONS? NA YES NO
The wrong box on d2 is getting checked off hundreds if not thousands of times a day. Someone please tell me why checking the wrong box here is worthy of not receiving a firearm if otherwise one is going to pass a nics check or you have your ltc?? Last IA says it is the #1 correction or oversight & wishes ATF would re-word. How would telling the customer to re-read & correct 12.d.2 give a huge heads up to felon?? Why not allow customers know where they went wrong here??
We cannot transfer a gun even you have your ltc unless the paperwork is correct & I'm willing to wager this was the mistake made as all the other are very clear...how hard is it to have them re-read, line out, initiaL & correct 12.d.2?? I've had business owners, Dr's, accountants & other very intelligent people check the wrong box & even miss it completely. If Academy is banning folks 30 days & putting their name on the list for this normal occurring mistake, then they deserve negative press.
I'm with the OP & glad his friend got his hellcat from another dealer...screw Academy when it comes to firearms sales, they won't sell AR's in certain areas, they fire employees for trying to stop theft & now make a no buy list on customers without divulging the reason on a 4473 that was not even called in?? Yeah, it's their business and policy but it's the customer's money.Last edited by Artos; 02-04-2020, 02:35 PM.
