    Who should repair?

Oncor came out and put in a power pole on our property. Before the pole was put in someone had come out and put a flag in the ground and it said Milam water supply, hand dig only.

Well they went ahead and put the pole in and busted my water line. I just turned the valve on last weekend and water started coming up around the power pole. This water line goes back to where we will build a livestock barn later so i put a shut off valve on the line.

Oncor is responsible. If the locate was properly done and accurately marked then it's on them.

They asked if it was on my property or the county right away. I was not sure the answer. Then i spoke with neighbor who was leading the power project for all of us and he said it was for sure on the county right away that is why we did not have to sign any easement agreements.

Oncor was trying to back out saying it was on my property until i pointed out i never signed an easement agreement.

So far they are crawfishing on me. It is an easy fix with a mini excavator or a strong back and shovel. I have neither so it would be a $300 rental. Not the worst thing, but not really wanting to dish out another rental.

Call the Texas railroad commission and see what they have to say. It's a pipeline, just transport's water lol

Seems pretty clear Oncor is on the hook regardless of where the pole or line was located.
It was marked and they disregarded the mark. The pole couldve easily been moved one way or the other.

It would seem the Oncor yoohoo would contend that if they broke anything on a private parcel they are not held responsible for repairs? Thats not right.

The squeaky wheel gets greased. Im more of a pots and pan banger than squeaker.

                    Good luck Mike.

Call their Investor Relations person and let them know that you will be filing with the proper state and local authorities as well as ERCOT about their negligence if you don't have an answer by COB. They will perk up.

Dang shame, Oncore should have just owned up from the beginning and fixed it. stuff happens, they got the equipment and could fix in less than an hour.
