Bonuses and child support?

    sadly it depends on how the judge feels that day.....they have a lot of leeway in it, my judge denied my vehicle deduction on my taxes even though irs accepted it, just said "I'm disallowing that"...….there is a very simple formula but I'm betting he is hosed on the bonus, my OT counted whether it continued or not, thank god it's all in the past now.....not sure how she pays for her new jeep now

      I practice family law and I've dealt with this issue extensively. Once the order is set, that is the only amount that comes out of his check every month until the order is changed.

      Once the order is set, the amount is set, he can triple his income and the same amount is going to come out of it.

      You don't see a variable amount coming out every month. The employer does not have to calculate X percent every month.

      The employer just takes the amount that the court orders which is again, a set, finite amount until there is a new order modifying the previous child support order.

      I don't see what is conceptually this to get

          The way I understand what the OP is asking, the order hasn't been set yet and wants to know if his employee will be paying a higher amount because of a one time "real good" bonus.
          The court could also review his last 3 years salaries and then take an average off of that. I've seen this done before.

              My divorce was 30 years ago so it may have changed how they do thing but I turned in 3 years worth of tax papers they made a average from them and said you pay this. I was kinda lucky I had not worked a lot of over time then.

                I was replying to some of the comments that seemed to indicate a varying amount each month.

                They can look at the last 3 years and it's kind of up to the judge and the lawyers.

                Generally I look at the last years monthly pay stubs. In this case I would look at pay stubs from Jan 1 2019 though today and last years tax return.

                That's the general way it works.

                Fam code says all sources of income essentially.
                Bonus
                Overtime
                Disability

                  It's a scheme. The more a child is kept away from the father, the more money the mother gets. It's an adversarial system designed to make money for the family court lawyers and the judges they buy when they elect them.

                  It's an entire cottage industry that the average person that hasn't seen the system from the inside knows nothing about.

                  The "best interest of the child" is a complete farce.

                  There is no accountability in the system, and if you want to drill deeper, you'll find a bunch of man-haters staffing the AG office, encouraging the mothers to have the child support recalculated as frequently as possible.

                  A simple 50/50 possession schedule would be great for kids, but that doesn't fit the agenda.

                    Rod you know how I stand on this and we’re on the same page. I know I spend $2000 a month in CS and insurance. That doesn’t include the extra $$$ spent. As for the OP if the CS is already set tell said employee to keep his mouth shut. CS is determined at final hearing and can be challenged every couple yrs. if the divorce isn’t final I might ask Boss to delay paying it until divorce is final.

                      what a ridiculous concept. equal time for both parents? who both made the kid?

                      i only get 50% custody during the summer and of course get no change in CS. wish court didnt cost so much or i had a loaded dad to bail me out everytime.....wait getting side tracked
