Question for Cattle Ranchers

    Assuming this is down the perimeter of your place I would do the following.

    1) Have him have a fence built that sections off the easement. In trade he gets 5 years of easement access.

    2) At the end of 5 years if he has done right by you and respected the property I would negotiate a permanent easement.

      Totally agree and I'm not concerned with cowboy taking and dip and really wouldn't care. My wife's little Oasis around the pool suddenly being covered in Cow pies is a different conversation. What has changed with me owning is Black buck, protein, alfalfa, and corn feeders with no fences around them; pool, etc.

      I was trying to figure out sell him piece or just create a travel corridor where it doesn't matter if he left gate open. Then charge something small per year for usage just to insert some language protecting me in case someone got hurt. I'm leaning towards just selling that little section.

              and this fits into something every rancher knows... "Good fences, make good neighbors"

              Plus this gives you to decide for long term future ideas as to whether or not it is a good idea to sell him that piece of your property... If in the future he sells all his property and a developer moves in, you could now be surrounded by no telling what since now the two pieces of property are contiguous and it surrounds you... As long as you own the land between his parcels, you have a bit of a deterrent to something like that happening...

                I cam Friday. I left all of that at ranch last week. Really not a big deal. Just curious on opinion on sell vs lease a travel corridor.

                  Man in your situation I’d sell him the particular part. But tell him it needs to be fenced off. If he doesn’t want to buy it then make him a corridor like what you were saying. He may be a good ole boy or not but your the new land owner and sometimes things change. It sounds like you have a nice pool and spent some work there, I wouldn’t want cows tromping through it either.

                    Oh that’s not bad. You could fence that for less than 1k or even just run a temp electric fence and then take it down once a year

                        Hell no I wouldn’t sell him anything. Why should someone sell their land they paid for so someone else can run their cattle? That doesn’t even make sense.

                          It's minimal to me and having a bad neighbor will take mental years off your life. Trying to be a good human. Not this guys fault previous owner didn't follow through with agreement and sell me the entire ranch.

                            So really he does not have a legal easement today correct? Does he even realize this? May make that clear to him and he may come up with a solution for you himself. If it was me and he was still upset after learning he didn't have an easement my approach would be much different than if he was apologetic and tried to offer up a reasonable solution. No reason he couldn't sign a liability waiver or better yet carry a liability policy for you. We carry one for the ranch we lease and it's not much.

                              My call with him yesterday left me with the impression that he thinks there is an easement and an easement is an easement. When he was done I told him I could understand why he was frustrated but that it wasn't a utility easement there it doesn't necessarily mean it's infinite. I told him for time being he could use but please keep gate locked while I pull the terms of easement. I asked that he meet me at my place on Friday and discuss a work around and that I want to do the right thing. He settled down and seemed to be ok with that.

                                He's upset? Thats not being a good neighbor.
                                I'd get upset and ask why he was trespassing on my land. My locks wouldn't come off until he came up with a reasonable solution that I felt comfortable with. Let him do all the work. Hes the one that is benefiting from the deal.
