    Need easment / help

    My neighbor has a house that he is living in already on his land 10 or so acres. He has asked that I grant easment rights so he can attach to my power pole for his new house on same land only closer to me now. Very close. I told him I might consider granting an underground line but not overhead. I am looking for clues to easment compensation rules adjustments,whatever. Also I have a concern about the new placement of the new house messing up drainage on my property because of the raising of the house plot. Also where can I find out how much land he actually has without asking. I am concerned that he may be building at time of sale and trying to keep from replatting.

    I am so confused what to do and I come to TBH brainstorming group for advice and help.

    You can look on CAD for your county.It will have a lay out of his property.Last time I had power poles placed the electric company had there own easment.Nothing you can do to as where he puts his house as long as it's so many feet from the property line.You'll have to dig a ditch if there's dranage problems

      he cannot change the "lay of the land" so that your property flood.

      call the county and talk to them, thay ca nanswer all the questions your asking now.

        Get some professional help and check into it. We have family land that we are landlocked out of. We went to court and could not get a valid easement to physically get to our property. One section in West Texas (640 acres), the neighbors hunt it and just said no to our request. The judge backed them up.

        I do not believe you are required to grant one.

          If he is already living there, surely he has electric.And if so, he doesn't need easment from you. Only reason he may want it is because it may cost him x amount of $$$ compared coming off from you. Same thing happened to me. Neighbor behind me wanted to come off from me, which meant coming down my property line or straight across my property. I denied him access due to the fact he had access from his brother in law, and he didn't want to run it across his wide open pasture. My place is all woods and I didn't want to have to cut any more trees down.

            You can go to the court house or city hall and look up the deed requirements and also the property lines. As far as the easement if it belongs to the city and which most do no-one is allowed to build on it. Have to check with city ordance. Also if his new house is higher than yours, it will probaley flood.
            The builder of such house will be the one who is soupposed to know this and have all the drainge done .

              The county permitting agency will have all your answers when you get down there. All property has an easement around the perimeter for lines and such. I would bet he is asking to avoid costs only, I would also bet a dime to a dollar that he puts his house where he wants it whether you grant the favor or not.

              I would take some pictures now in order to have them for the future. I have seen some changes in the lay of the land, like guys on 2.5 acres digging a 1 acre pond. They used the dirt to build up their lot and now they are 3'-4' higher than everyone else. Now when it rains, their place is high and dry and the neighboring lots are a mudhole. Nothing has been done yet in years time,,,,,

                  The only reason he would be wanting you to grant an easement in an acreage situation is to save him money. He will have to bring a line in from farther away costing him more. This may also be why he wants to build close to you to shorten the distance you grant.

                  Getting power to the inside of property has changed over the years and is an expensive proposition these days. Many power companies used to give rebates if permanent residence was set up on a property but I'm not sure they still are due the cost.

                  Unless you live in an incorporated city/town with zoning laws there will be no mandatory easements on the property perimeter. Rural property is pretty open and easements only granted by the property owner.
