    Right to bear Arms

    Ok, for those of you that have a law degree, lol.....got a question. I am 24 and when my mom was pregnant with me my dad made a bad decision. Anyway, he didn't do any jail time but part of his probation was to lose his 2nd amendment right. He never did get it reinstated because he didn't want it to come up on any job applications. Now he owns his own buisness and hasn't even had a traffic ticet since. How does he go about getting his right back?

    Contact a lawyer.

    I don't think he can get them back unless he is pardoned by the governor if it is a state charge or president if it is a federal charge.

      Bad decision...you might have to be more specific to get the proper answer

        ok...he use to have the paperwork for it...maybe it was pardon papers...not sure.....thanks for the response....

          Once you receive a final conviction on a felony, I don't think there is getting your rights back short of that pardon. It is not like you can fill out some paperwork and get it reinstated.

          By state law he can probably have a firearm but the feds don't care about state laws and once a felon, always a felon.... unless that pardon comes through.

            If it was that long ago, he needs to check and see IF he actually gave away his right to firearms or if it was deferred adjudication where his record cleared if he successfully served his probation without it being revoked.

              bsills....he use to deliver gas to gas stations.....some of the guys he worked for would take the extra gasoline at the end of the day and sell it on the side for extra money......he ended up handed a check from one guy to the other...

                I got a law degree, but haven't read a word of criminal law since law school. I'd contact a criminal lawyer and I think there is a chance the record can be expunged.
