It's illegal to "capture, trap, take, or kill" any wild animal or wild bird on a public road or the right of way of public roads.

Hunted in Wisconsin a few years back and seen a car hit a deer, called the sheriff he ask if I wanted the deer, said sure, he told me to gut it while he filled out a car kill tag. Then he said the deer was mine to take. I ask him to what if had been a decent buck? He said they would have done an investigation to make sure I did not intensionly hit it, then if all clear I could have it.

I know a guy that was hunting during bow season in the hill country and their lease spanned across the highway, so he had to take the buggy back and forth across. Came back from the morning hunt and there was a young buck on the side of the highway that had just been hit but was sill alive. He call GW and was told he was on vacation and the other GW was on the other end of the country and all sheriff deputies were busy. If he felt comfortable shooting it go ahead but leave it there.
