Need Input - Neighbor's property runoff - residential

    Set up a meeting with him, bring pictures and just explain that this is an issue that must be fixed. Ask him what would he want you to do if the shoe was on the other foot? If he doesnt get it, then take further action

          He's your neighbor. How you handle this will have long term implications. Give him a chance to fix it. If he doesn't then keep working with him/ needling until he does. If that doesn't work, invite him over for beer every evening. Then maybe to the deer lease. Maybe take-in a strip club every now and then. Eventually his wife will hate you and they will move. Then start over with your new neighbor.

            Thanks again for all the input. I'm not sure I follow this guy as each time he goes and gets a piece of equipment to work, there's a huge chance of rain, much like today. 90% chance of rain and he's got a skidsteer moving more dirt. His grade is now at least 6" above the base of my fence and no attempts have been made to scratch it away to create a natural ditch.

              It seems like he's building his yard up high enough to avoid any pooling of water with no consideration of his neighbors.

                        Every time it rains I'd hook up a 2" trash pump and blow the water and mud that comes on to you, back all over his car.....

                          Any conversations with the county environmental dept? Sometimes your transportation departments house people involved with streets and drainage. Most likely, there will be someone monitoring discharges although they are most likely concerned with larger construction.

                              Grab a 12 pack and sit down with the guy. Get to know him. Unless you plan on moving he's gonna be your neighbor for awhile. There are plenty of simple solutions to this problem. He might know how to drive a tractor but might not know anything how to properly drain the space between your 2 houses.

                              I added on to my house last year and the rain has to flow to the street. There is no other place for it to go. I installed a few french drains, guttered the whole house, cut the driveway,ran underground and have most of the rain hitting the street in a 6 inch PVC pipe. Tested and works great.

                              My new neighbor is going through the process now. Nice guy, just has no idea of anything with problems like this. ten thumb kinda guy. I addressed my concerns and he said he would ask the contractor to talk to me. Talked to the contractor one day and he said he had never dealt with drainage issues before and gutters and drains were not in the bid. I told him it will be an issue, just wait till it rains and you will see.

                              Few weeks later it rained for a few days. Neighbors backyard was a pool for a week. The contractor came over and asked to see what I did to get the water to the street. I said sure. Younger guy but willing to learn. He took tons of pictures, asked lots of questions and asked me for my opinion of how I would to it next door.

                              Problem solved. Never thought to call an attorney.
