Even if he is charged as an adult he may not be given the death penalty. That being the case I would guess they only charge him with capital murder if they are going look at death penalty for an adult accomplice (even if just as a threat for better plea deal)

Thats sad, how many lives could be saved by getting a jump instead of waiting for approval.
