    Open carry Question

    Had a question about an open carry situation maybe an LEO or Lawyer can help me out. I am a shift worker so It's dark when I get off sometimes. When I run I would like to carry my pistol would carrying it on a "battle Belt" or competition shooters belt be acceptable. Technically it is on a belt and holstered so I would assume it should not be a problem. Thank you for your time

    As long as it in a belt or shoulder holster you are fine.

      Texas is a open carry state. I don't see any issues as long as you already have your CHL. Although, cops will probably stop you if you're spotted to 'question' you. Are you a member of Texas Law Shield? May offer you peace of mind and members have some pretty cool perks

          I have no clue what a battle belt or a comp shooters belt is but if it is a shoulder or belt holster the handgun is in, it is good to go..... in my opinion if it is actually being worn on the shoulder or waist.

          I have seen a lot of opinions that the law does not exactly say that the holster has to be worn but I think if not, it will likely end in an arrest and a test of case law.

          The law does not specify that the holster has to have a certain level of security if that is what you are asking. A competition holster is as good legally as a level 3 security holster.

            Im asking specifically about an external belt. When you think of a belt its meant to hold up pants and thats How I usually wear my gun but when running you cant wear a belt other than like what LEOs wear when they are on duty a secondary belt holding mags and a pistol. Im just curious if I where approached by an LEO if it could possibly be a violation by wearing a battle belt or competetion belt in a regular holster

                  According to how the law is written, as long as it is in a shoulder or belt holster you're GTG. Law doesn't even state it has to be worn, just states it has to be in one of those 2 style holsters. IMHO, I believe they failed to recognize the fact they didn't state it has to be worn in one of those 2 locations and I think they'll add that to the law in the near future.

                          I have a suspicion that it will likely result in an arrest if seen. Case law might define the intent or the legislature might do it but they could have reworded it this session and did not.
