1. He is being represented by a public (read: taxpayer funded) defender. Under the 6th Amendment, ALL persons accused of a crime with potential jail time are entitled to counsel during the major stages of prosecution. Those lawyers' jobs are to find every legal way possible to prove their client is guilty. In this case, that included making a claim that the homeowner was jealous of the women the burglar was sleeping with, and that the homeowner planted a trap so he could kill the burglar. If you ever have to have a public defender defend you, you better hope for the same.
2. The court didn't take it on. They dismissed the burglar's counter-suit against the homeowner, and sentenced him to 86 years in prison.
