Stolen iphone Question- what would you do?

First of all its just a minor possession and I'm glad my son is fine and a very gracious TBHer gave my son a like new Iphone 5....rest is just frustrating and as more pics and proof pop up, its hard to just let it go. I have been more than fair and nice about it all already!

couple weeks ago while son was on football field practicing , ex-player that had flunked out gets in locker room and with a KEY (whole another story and problem) opens all the locked combo lockers he can in time frame and goes through wallets, etc. Takes my sons Iphone4s in process.
Immediately everyone knew it was this kid and pointed at him as knowing that's who did it. Even coaches had suspected him but no one had proof. Kid everyone suspected even came up to my son with a piece of paper and pen and asked him pass codes etc and he would help him track it. Of course Trey told him no, that his dad was already on it. This kid has never spoke to my son other than trying to bum money sometimes.

few days later - morons take pics of each other with phone and icloud sends us pics! (when I guess they got near my office downtown and connected wifi- maybe at store next door or restaurant, etc... ) I had already cut phone off after it did not have track iphone on and reported it stolen after cops couldn't ping it couple days of trying. It was also password protected/screen locked.

I take pics to school cop, they pressure kid and couple others in pics and they finally admit main kid everyone accused had it. In front of his father (worthless POS been out of prison for murder and other things) he assures cop he will bring phone next day. He does and phone is smashed around button on front and back and wont come on - said it was dropped. I mess with phone and get it on and hook up to my laptop and find out its not even my son's- it was a 4 not 4s and was registered to some weird girl name. Just another of many lies to everyone's face. I told cop and coaches again and again I would NOT press charges if he would just admit he had it and give it back.. Then he lied and smashed already broken phone and tried to pass it off on us. I still didn't want to press charges out of fear for my son having to go to school with these kiddos involved. My sister who is a teacher has tried to talk to the boy- he calls her his favorite teacher- he lies to her face and so far all he has gotten is 20 days alternative school and a like new iphone4S. FF today, we randomly looking at Icloud info and it shows the phone now - named the kids freakin name that stole the phone and swears he no longer has it last they talked to him when trying to pass off busted up iphone.

Should I just let this go and let him go through system and end up 6ft under or in prison. I kept trying to have them talk to him but they said they have so many times its pointless- he aint listening.
or should I take this new info back to school cop again...took him all the pics originally showing ones face and Identifying two others from odd looking shoes I also printed off and identified those two from FB pages playing stalker detective...
skip school and just go to police and take them all I have.

Just like a slap in face when seeing the pics pop up or now the device on our screen showing his freakin name It still wont let us track it but I guess he wiped phone clean and renamed it. Its reported stolen so att says if they show it would be taken...but Im sure there are ways around all that.

If you go back to the school police be ready to prosecute. Might as well get him into the system now. It sounds like he is on his way. His future sounds already certain. If you decide not to do that let it go and pray that he finds God sometime down the road. Sorry you have to deal with this mess.

I wouldn't let it go. If the school won't handle it go to someone that will.

You already tried going through the school. Go to the police and file charges...

You seem to handle having $4-500 stolen from you better than I would.

File the charges. His next step will be doing things like breaking into my parents house or their cars.

Your son needs to see you take this all the way and get the phone back. Great life lesson involving numerous topics.

You just answered your own question. You've given him several chances to make it right (more than I would have done). Hand it over to the police and press charges.

Oh he's in the system already - in fact this may be a last strike.

                        Press charges if you can.

And then tell Trey to watch his back...

Would you son be able to whip his arse? Not saying that is the right thing to do, but that's how most problems in high school are handled. Of course as soft as our society has gotten, your son would probably be accused of a hate crime and discriminating against thieves. You should definitely keep on it. Good luck to you sir.
