Not Responsible for Broken Windshields

Ok, this is something of wondered about for a while now...

I always see hauling trucks with the warning sign on the back saying that they're "not responsible for broken windshields." Do those signs have any legal merit? To me it sounds like they're saying "Even if we're negligent and don't properly secure the load we're hauling, it's not our fault."

If the signs do have legal merit can I go ahead and hang a sign over my neighbors fence saying "Not responsible for errant arrows" and go to town practicing my 100 yard shots ?

I'm no expert but I'd say no. Figure they do that so 90% of people will just say "dang, there's nothing I can do about it." The other 10% probably gets it taken care of.

I caught a rock MANY years (1992ish)ago outside of Hahnville, La from a dump truck. Wrote down tag number, mile marker and time of day. Called my insurance company (GEICO back then) and was told basically what the OP posted. It was fixed by my insurer...........they never even reached out to the trucking company.

I think its BS. I could put a sign on my truck that reads "No responsible for wrecks" and then get in a crash and it wouldn't hold water.

You could also notice a chip in your windshield while in the Kroger parking lot and blame it on the next commercial truck you get behind. Not that you'd do that, but many do. DOT is tough on trucks hauling aggregate for this very reason. Also, how do you know if the rock falls off of a truck or the tires of the truck just throw an existing rock from the highway up into a windshield.

I know that some negligence probably exist with some truckers, but you can't imagine the number of crackheads that have called here over the years just wanting a check..."no need to get the insurance involved....just pay me $200 to fix my windshield". Uh......no.

I can't stand them. Around here they are the MOST inconsiderate drivers on the road. Driving 10 miles under the speed limit with 5 trucks taking up both lanes, pulling out in front of people, making right turns from the left lane when there oncoming traffic, inconstant speeds, always in the fast lane. I will say that the trucks around here keep their trailers clean and neat, I hardly ever seen anything fly off of one. I just get aggravated as hell by them, highway 46 is a popular route for them, unfortunately its how I get to work.

Proving the truck tossed the rock that busted your windshield is an impossibility unless you have video that shows the rock exiting the vehicle, the full route of the rock and it striking your vehicle.. and even then a defense attorney could poke a billion holes in it.

I got stuck behind a one ton covered with mud and rock. He hit a bump at 65 and the shower started. Broke my windshield in 12 spots. I spoke to the insurance company with tag, make, model, time, color and location. The insurance company ask me if it hit the ground first before striking my truck, I said I think so it all happened so fast. Insurance company stated that since the mud/rocks hit the ground first they were not liable. I even called a lawyer friend he told me the same thing........

I don't pay for my own broken windshields if I see a rock come off of a truck.

The city of Dallas thought they could get around paying, but they spent about eight grand for a three hundred dollar windshield....thanks to one of their garbage trucks.
