    Title transfer question

    Here's the deal. Dad passed away and title was in his name. Will stated everything went to mom but has not been probated. She wants to gift the truck to me.

    Does she have to wait for probated will? Does she need power of attorney?

    No problems with will or anything, she is just in a hurry to get rid of it. She no longer has a drivers license and wants to do away with car insurance.

    Probate the will, it will take care of any problems down the road.

            Under Transportation Code, Section 501.074, the department shall issue a new title for a motor vehicle for which the ownership is transferred by operation of law. In some situations involving a deceased owner, the heirs may sell, transfer or assign ownership of a motor vehicle using Form VTR-262, "Affidavit of Heirship for a Motor Vehicle." The deceased owner's death certificate is not required and should not be requested to transfer ownership when this affidavit is submitted.

              If there wasn't any debt or little debt when he died, it could be probated quickly, easily and in a manner of weeks (approx 4 weeks where I practice).

                If all else fails get a bonded title for a few bucks.

                      Now they charge you on the value of the truck not the purchase price so it could be expensive

                          We used Ron Butler for the probate of my FIL's estate in Williamson county. Would not use him again.

                            Thanks, We started to use Terry Davis but he was to high. Simple well written will. We have someone now just been putting it off. Just over 2 months now things are beginning to settle.

                            I think I met you several years back at a baseball game in Lorena.

                              Any property of the deceased can be sold by the estate during the probate process before it is finished. Start the process. Executor or executrix of the estate can sell, assuming that'd be your mom.
