    Answer to CCW on public land

    The question was asked here a while back about the legality of possessing a concealed handgun on public hunting land in Texas. There was some confusion about it and some folks that said "no" you cannot carry on public hunting land. Well I have found the answer and it is in the prohibited acts section of the public hunting section of TPWD.
    It says and I quote" Notice: The prohibited acts and other public hunting regulations do not in any way restrict a person having a concealed handgun license from possessing a concealed handgun, loaded or unloaded, on public hunting lands in strict accordance with the concealed handgun laws."

      As far as I know, there has never been any confusion about this. It has been that way for as long as I remember.

        You mignt want to check with the Hunting Program Manager at the Lake Office if you are hunting Corps Land. It is public land I know, but it is also Federal land, not State Land...therefore rules tend to be different. I know that in years past, you could not be in possession of a concealed handgun even with a CHL.

        It's best to check first, beforehand, just in case you get into a bind. Ignorance (the lack of knowing) is not a justifiable reason, especially since all citations on Federal Land go before a Federal Magistrate.

          National Forest property is off limits to CHL and I'm not sure on the status of Corps of Engineers.

            Link to original thread? I thought the original question was in regard to carrying during the archery only season on public land.

              I personally soke to the head Game Warden CraigHunter and I asked him about CC on the public waters in a kayac etc And he said it dosnt matter where you are on public land or water as long as it isnt spicificly stated that CC isnt allowed e dams power plants etc it is perfectly fine to CC. But you must let the warden know if checked etc.

                This is an interesting subject.

                From the national USACE Rules and Regs...

                327.13 Explosives, firearms, other weapons and fireworks.
                (a) The possession of loaded firearms, ammunition, loaded projectile firing devices, bows and arrows, crossbows, or other weapons is prohibited unless:
                (1) In the possession of a Federal, state or local law enforcement officer;
                (2) Being used for hunting or fishing as permitted under 327.8, with devices being unloaded when transported to, from or between hunting and fishing sites;
                (3) Being used at authorized shooting ranges; or
                (4) Written permission has been received from the District Commander.
                (b) Possession of explosives or explosive devices of any kind, including fireworks or other pyrotechnics, is prohibited unless written permission has been received from the District Commander."

                I read all that to mean NO, you cannot carry a loaded, concealed handgun WITHOUT written permission on USACE land unless you are a law enforcement official or are "hunting" with it...and there aren't many USACE public hunting areas that allow anything but archery equipment and shotguns for hunting.

                  dont think you can carry on corps land. type 2 land is ok.

                    YOU CANNOT CARRY A CONCEALED HANDGUN ON ANY FEDERAL PROPERTY!!! That includes COE lands, US Forest Service, and yes, even the Post Office. If you have a CHL, then you SHOULD already know this.

                      The land in question was type 2 land! Nobody asked if they could carry in a post office. My type 2 book says that I CAN carry when I'm hunting on type 2 land and the prohibited acts "in no way" prohibits me from carrying. It is in black and white.

                        Corp Property is included. I got in trouble for having a shotgun in my truck behind the dam at Lake Proctor one time and got the lecture of a lifetime from that game warden.

                          Type II have always been open to CHL carry.

                            Type2 land - legal

                            National Forest or Corps of Engineers land - NOT legal.
