    Yeah. It's high. But getting slapped with a felony for stealing a fourwheeler is a little different than getting slapped with one for beating someone into a coma.

            Extremely aware! Called on state and county prisons/jails over 8 states for Eli LIlly pharmaceutical. the stories will make you cringe. Many are bums that will always be in trouble. Some are doing there 2nd stint because could not get a decent job or even opportunity based on previous issues. "Forgive but don't forget" is fine as long as you look at the entire person and current situation. I have two cousins that fit the bum category..........full disclosure!

                  Generally speaking, criminal trespass is a B misdemeanor. If you carry a deadly weapon (such as hunting), it ups it to an A misdemeanor. Trespassing in a habitation/home is also an A misdemeanor.

                  On agricultural and and within 100' of the property line is a C misdemeanor as is trespassing at a school (in the Education Code).

                  And so on.........

                      Thanks tvc. I could have sworn there was the possibility of a felony while hunting on private land.

                      You know what. I may be thinking of Colorado. I'll look into it.

                        Can you site this? I was under the impression that in Texas, trespassing with a firearm was a felony.

                          Sec. 30.05. CRIMINAL TRESPASS.                           I deleted all the long winded definitions such as what is notice, what is entry, what is a critical infrastructure site (like a refinery or chemical plant), etc.

                          (2) a Class C misdemeanor, except as provided by Subdivision (3), if the offense is committed:

                          (B) on residential land and within 100 feet of a protected freshwater area; and

                          (3) a Class A misdemeanor if:
                          (A) the offense is committed:

                          (iii) on or in a critical infrastructure facility; or
                          (B) the person carries a deadly weapon during the commission of the offense.


                          I also deleted the defenses to prosecution like if a firefighter or EMS was responding to an emergency, police officers carrying past a 30.06 CHL sign, etc., as it does not deal with the degree of punishments.

                            As TVC pointed out, it's not a felony.

                            But on another note, it very hard in Texas to unintentionally trespass onto private land unless you are a moron.
                            Private land has to be marked by sign, paint or fence iirc, before you are considered to be trespassing. There isn't a whole lot of private land in Texas that doesn't meet one of those three criteria.
