(B) the person carries a deadly weapon during the commission of the offense.
I also deleted the defenses to prosecution like if a firefighter or EMS was responding to an emergency, police officers carrying past a 30.06 CHL sign, etc., as it does not deal with the degree of punishments.

As TVC pointed out, it's not a felony.
But on another note, it very hard in Texas to unintentionally trespass onto private land unless you are a moron.
Private land has to be marked by sign, paint or fence iirc, before you are considered to be trespassing. There isn't a whole lot of private land in Texas that doesn't meet one of those three criteria.
