      According to Sec. 204.010. POWERS OF PROPERTY OWNERS' ASSOCIATION that you posted the board of directors can create fines, policy and procedures.

      Sections 9, 10, 12, 14 cover fines and assessments.

      Policy and procedure amendments are covered in Section 1 and in other places throughout what you posted.

          First thing you should do is make certain the HOA is registered with the STATE of TEXAS. If it is not, then it really doesn't exist. It has to have been filed and registered. Then see if you can get involved in the board and the process to make certain you have a say in what happens. HOA's do have a purpose that is designed to protect all the homeowners, but they can sometimes get a bit out of hand.

          They are also only as good as the inforcement, good or bad. If they have good rules, but don't enforce them, then they are worthless.

            I'm the president of mine and our president is one awesome guy!
            Your HOA bylaws and covenants will dictate what authority your board has. Any meeting that includes a vote, must be open to the public. That's state law. Fines are levied due to whatever is in the covenants. Our board has the authority to raise rates, but hasn't done it without a membership vote.

              Let me get this straight. You want me to pay you so you can tell me what I can and can't do with my property that I own? Then when I don't do it the way you want you are going to fine me?
              Oooo and the rules don't really apply to you and your friends because it's what you want.

                More like they have a simple set of rules that MOST of the time are basic and easy to follow. This keeps idiots out of nice neighborhoods and driving down property values. Most of the time they are non profit and the money you pay goes to improvements in the neighborhood.

                Seems like something I'd like to have

                  That's pretty much how I see HOA's to be, and is why I will never buy any property where I have to ask permission from strangers to do what I want on my property.

                  You forgot the part where people VOLUNTARILY agree to be part of a HOA, then turn around and complain about the HOA.
                  Makes about as much sense as people who buy a house near a railroad track, then complain about the train horn blowing.

                      I have never understood why someone who knowingly buys a home within the jurisdiction of an HOA would then complain about having to abide by the bylaws of the HOA.

                      And the price you paid for your home has nothing to do with the future value of your home or whether or not your neighborhood will someday turn ghetto.

                        OP - I'm in the same boat as you. I think the problem is that we are a new neighborhood and just took over HOA from developer. We have no bylaws yet, and I think our president is doing whatever he wants. I've looked up some info but found nothing I could do lawfully.

                          I disagree with this. There are $500k-$1mil+ homes just outside our HOA and some of their neighbors homes are worth $20k at best. The homeowners of the larger homes have no say in who buys the lots next to them and what they build.
