    Backing out of contract?

    Here's a good question for everyone. Please reply if you've been through this before.

    So, a friend contacted me yesterday evening that he bought an ATV to go out riding with us. He's been really wanting to get into all of that and was excited he got a deal done. They have to get the four wheeler from west Texas since the dealer didn't have one in their stock but their sister dealership did. He signed all the paperwork (financed) last night and is just waiting for it to come in today to pick it up.

    This morning he calls me telling me that his wife didn't take things too well. It was either her or the four wheeler type deal. He now wants to tell this dealership that he doesn't want the four wheeler and wants them to void his contract. They have a $1500.00 check of his which has not been taken out. He hasn't taken delivery of the four wheeler. He is asking me if he is legally bound to take delivery and pay for this vehicle since he signed the paperwork already?

    I have never experienced anything like this. So, I figured someone here has to have gone through this before.

    I believe you have 3 days to back out in Texas. I may be wrong though.

        If it's a honda ditch the wife and keep the four wheeler, less problems down the road. If it's a polaris tell him to back out at all costs and keep the wife, less problems down the road

          The CFO is litteraly sitting on and gold mine. If you want your share of said gold mine you must get any and all purchases ok'd.

            We are talking Can Am. Don't know where that falls on the ditch the wife vs. keep four wheeler spectrum.

            There is no "3day cooling off" in Texas per the Attorney Generals website.

              Lesson:
              Never ever ever ever ever EV-ER tell the wife until AFTER you take possession.
              Easier to beg forgiveness than ask permission.

              Best he consult an attorney.

                  The three day cancellation rule does not apply if he bought it at the dealership. If they came out to his place to solicit the sale it does. Sounds like he's pretty well at the dealer's mercy>

                  The best argument he has is that they haven't delivered or registered the machine yet, so they're not going to have to then try to sell it as used. If it was me I'd go down to the dealership and explain what's happened, offer to cover the cost of getting the machine from the sister dealership and thank any and all applicable powers if it worked.

                        Why not be a man of his word, do the right thing at the dealership and then sell the 4 wheeler outright to make everyone (except himself) happy about the situation?

                        I was just reading a similar thread on the F-150 forum earlier about a guy that did upgrades to his truck and his wife got mad that he spent the money on his truck when they had bills due and young kids. I couldn't believe how many suggested for him to ditch the wife. Is the marital relationship really not worth more than a lift kit, floor mats or a 4 wheeler? I'm sure most were just kidding, but when the majority of marriages end in divorce, it sure is concerning.

                            Ummm, I would and have before. My wife doesn't ask many questions. Heck I spent $30,000 on my truck and never told her I was buying one. When I got home in it she just came outside and said "Nice one".

                              If the wife is serious about her threat, I would question her commitment. I mean seriously the dude screwed up by not at least talking to his wife before purchasing but threatening to end a marriage over it is way over the top.
