Also, if you have a lawyer, you may want to check with him first, but you may have a civil/criminal case against them.

(reprinted from the EastBay RC blog) Here's my brief summary and analysis of the Texas "Drone Law". There's been a lot of odd ("botched") reporting on this, so I'm hoping that this will help clear things up a bit.  Why it's so difficult for reporters to actually read five pages of surprisingly clearly written text is beyond me.  It took me about two hours to go through and type this up.  NY Times, give me a call! Later I'll do the same for the California bill (much less clearly written!).  As always, leave me some comment or corrections if you've got them! I've highlighted some important parts of the text concerning civilian or hobbyist use.  Scan down and read those and you'll have a reasonable idea of how the law applies. tl;dr: If you're flying over public property, private property with permission of the owner, or not intending to surveil a particular person, you're good to fly by this law. The bill addresses what kind of pictures/video may be captured from an unmanned…

Did you get his license plate? I'm guessing he wont be controlling the drone from such a visible spot any more.

I'm relatively sure that shooting the drone down(while satisfying) will just cause you more grief. Generally speaking my understanding is that two wrongs do not make a right. Him using his drone over your property, doesn't give you the right to destroy it. As for SSS, it is entirely possible that video is being transmitted back to him, and can be recorded there. In which case, he may very likely be able to prove you're the one who destroyed it....

Anyone know how much those net guns are, the ones they use to capture wildlife? Could probably catch the drone with no/minimal damage, and use it as evidence.

Forgive me for being a realist, but I bet if....

It is against the law for him to retain footage of what the drone camera is seeing of private property or people. If I shot it down and he had footage then he would be incriminating himself by showing that he was retaining the footage. Now tell me how I can determine he is or isn't retaining the footage. There is no way to know if he is breaking the law or not unless I do shoot it down, not that I have ever insinuated that I would shoot the drone down.

I took pictures of his vehicle and plate number. He was about a forties age guy and was wearing an NRA shirt. He seemed like a reasonable guy and I really do believe that I won't see it again.

Did he say WHY he was flying over your place?

So if it is against the law to have the footage, how does Google Earth street view remain legal?

He was just flying it around to test it out and the big hill let him go farther with the new antenae he was making for it. I just happened to be where he wanted to fly I guess.

On the original thread there were 3 different people posted the new drone law and that is what it said. Also 2 different LE sent me the law in PM's and that is what it said. Trust me, I'm not making this stuff up. It seems wierd to me too.

You handle the situation very well
Yes there is a drone law for Texas I just saw it last night and thought of the other thread.

Like you said yourself. Google STREET. Street view from a public road or place anyone can video or take pictures. 300 yards back into someone's heavily wooded place, behind closed gates is completely different. Bob, you need me to come have a talk with him?

Not as good as LDPics but I guess it will have to do. At least you didn't string it out like the copper thief thread and then just leave us hanging.

I think you handled the situation as best as you possible could have, hopefully it's resolved now. Just shows that doing things the 'nice' way pays off. But like you said, that's his ONE warning

Streets are public. And that view is not a live feed

At least you made a peaceful effort before it happens again. These drone people are starting to sound like the open carry idgiots. "But the law says..." Blah blah blah... respect people's personal property, policies set in place and common sense. Next time it happens, someone will more than likely will walk away with a black eye... I might not be there in a quick fast and hurry, but I have your back Draco. Just let me know.
