    personal property question

    Here's the deal. I purchased my home from a friend in August. He moved from my place to a smaller place with less garage space and property. We have a verbal agreement that he can keep some of his stuff in my garage and on my property until he was able to build a shop. The spirit of the agreement was that he would use the money he got from the sale to build the shop, and that he would remove his property in a timely manner.
    It has now been 7 months. He blew through the money he made from the sale, and doesn't have the money to build a shop. I have gotten him to move some of the stuff, but now he is dragging his feet and says he doesn't have room for the rest.

    What recourse do I have? It's my understanding that once the sale was final, I now own the property and everything on it.

    call and tell him, "hey bud, its been 7 months. you need to come get your stuff or I'm gonna have a garage sale."

            I would agree with the "come get it or else" (in a nice way) ultimatum. That said, if its a lot of valuable stuff and I sold it all Id then give him the money. It might keep the friend...

              If he's been using you for free storage for 7 months, he doesn't sound like a good friend to begin with.
              I'd go with the garage sale threat and follow through in 3-4 weeks.

                    I think the problem lies with the original agreement. Despite what he said about using proceeds from the sale to build a shop it does not sound like any timetable was set. The whole agreement sounds a bit loose and open ended. I think at this point the reasonable thing to do would be to let him know it's time to move his things and set a reasonable time frame from the date of the conversation, say 60 days, and come to some agreement about what is to happen to any items still remaining after the 60 days.

                              Super Dave this is a Hugh Crisis situation! If he is a true friend all you have to do it ask him to remove his stuff(7mons) has been long enough. Other wise cut ur losses and load his Crap and move it to his porch, it's simple man don't sweat on the small stuff.
