            The state could terminate them anyway without regard to a US court ruling under the 10th amendment... maybe...I might be wrong..

              I understand that the judge is just following proper procedure,protocol,and making sure that when this goes off,it goes off without a hitch…But man,it would be awesome if the judge could say: "you know what,Hart8 has volunteered to put however many bullets in you it takes to end your life.He will see you as soon as he gets off work"…. It's just a matter of time before they fill him with poison.

                      This isn't about prolonging his life. It's about finding out who is manufacturing the drug. The whole point of this is to intimidate all drug companies and make it too unsafe and expensive for them to formulate the drugs for the state. It is my understanding that not disclosing their identity was part of the contract between the state and the manufacturer and a condition for selling the drugs. The state will now have to appeal it over her head to the 5th District.

                        Yep, I am pretty sure you are wrong. Federal Courts can and have overturned death sentences in Texas.

                            The court issue has nothing to do with the sentence, only the manner in which it is being performed.

                            But we are both smart enough to see where this is leading, its stalling for time. Once disclosure is made the defense will then have a "paid for" professional witness say its not safe...
