If you had a hunting product idea??

How would you go about getting it started? I know what companies i would want to pitch the idea to. But would I need to have the idea/product patented first?

I just had this conversation, at lunch, with a guy who has a company that produces some hunting products. He has the company he goes to talk to, with a new product, sign a nondisclosure/ no compete contract before showing the product.

How viable do you think the product is/will be? The reason I ask is I have a man I know that will and has entertained this, however he would want it to be protected as much as possible i.e. Patent.

It is actually something kinda goofy.. But would work like a charm.. There is absolutely noting like it in any industry that i am aware of.. I think that it would sell really well.

The main reason i think it would be successful is that it is something that would work anywhere in the country..

2 ways you can go about it.
You go and get the patent, manufacture and then sell it so show the value to a big company, or you sell the idea and let someone else take the above risk.

No you would not, but would want a NDA in place prior to talking to anyone about it. Also you could put everything together and send an email to yourself or a certified letter with all the details to yourself.
Might ask some of the atty's on here to assist you on this.

                  This plus a patent.

Otherwise one of the companies will just have a vision of the perfect product and take it to market. When you try to file lawsuit they'll claim they don't know you and never heard of you before.

Have you done a patent search for prior art?

How much is a standard patient? How long do they take to get?

Depends on the lawyer you use to help you get one.

Depends on the type of patent you are applying for.
Depends on how tough it is to get the patent reviewer to stop rejecting it.
                          Each rejection cost dollars.

Intellectual Property patents can run 10's of thousands of dollars.
                          Design patents can be less.

                          Good Patent Attorneys are expensive.

absolutely have to get the patent.. but keep in mind it will cost you probably a minimum of 10k for the patent because you have to get a patent lawyer to make sure it's patentable.. then go through the paperwork and all that. I had a friend that was able to get one done for about 8k, while I've worked with a company that spent well over 15k to get theirs.

You also have to have something like machine drawings or something physical. can't just be an idea.

If you don't get that and then take it to a company they can take your idea.

You still have to be careful though because just having a patent doesn't do much for you especially if they can modify it enough to take it out of patent.

Basically a patent just gives you the right to sue someone over infringement which is not only a long process but an extremely expensive one.

The best route would be that you find a manufacturer and draw up a contract that they agree to not produce it for anyone else.. Make sure your patent is stamped on whatever it is, from there produce large quantities and take them to retailers that might want to sell it.

As opposed to trying to sell the patent to a bigger company. Lots of people go into it thinking like that, but the reality is something entirely different.

first things first.. get a patent lawyer.

Except most company could probably care less what you have and wont get into a big lawyer brawl before meeting with you just because you said you had something.

I've actually had a company try to sell me a patented product like that but wanted me to sign a NDA.. So they sent this huge thing to me I started reading realizing that a lawyer drew it up and basically they can write all kinds of garbage in it..

So I had to turn it over to my lawyer when I realized I don't care what this guy has..

Of course he was quick to say nevermind and show it to me anyway, but just keep it in mind..

A big company is not going to go through a big legal hassle just to see an idea some random guy came up with and says is good.
