Lease property question

I asked this question on another thread but i think it got burried. So here goes.

For those of you that lease out your property to hunters. If a hunter, his guest or dog or whatever damages your property, kills a calf whatever, the hunter is responsible and should do whatever it takes to repair or replace. I get that. But what if the land owners cows tear up a feed pen Or knock down a feeder or break thru the fence at camp and tear up the place or kick a dog in the head and kill him? Is the land owner held to the same regard or is it just "tough luck, you chose to be here"?

What say you?

I dont lease land but hunt leases and family owned land and if the cows at the lease or on family land tear something up I dont hold the land owner or my dad acountable for the damages to feeder I just look at is as I should know better to build a pin or a better one if they tore it up.

know if I make a mistake and shoot a cow then thats on me to replace If I mess up and damage a fence by driving through it or a barn thats on me.

I don't think they are responsible. We have had cows knock over feeders before and we have not tired to put it back on the ranch owner. We also had some dumb arse leave a gate open and of they are missing calves come count time we are responsible for replacement. It's is written in out contract.

Depends, do you want to stay on said lease? I think it's a tread lightly issue. Supply & demand issue- just based on "in search of lease" threads on here lately, the landowner holds the power.

I wouldnt hold the owner liable for ANYTHING his cattle do to my property...NO WAY. I think that would def fall into the tough luck category. Now, if one of his guests, kids, etc damaged my property then we would need to get the issue resolved.

normally when you lease property from someone you relieve the property owner of all responsibility and you accept all responsibilty, with that said no the property owner would not pay damages.
I was on a place and the owner had goats, they scratched the ÷€¥¥ out of a brand new truck I had and put several dents in it one night. I was hot, but I accepted the responsbility and moved on.

I've had several feeders knocked over,and corn gobbled up by jackass'…Motors,spin plates broke etc..I built better pens,and bought better equipment..Cows never tore up anything really,but Jacks,and Jenny's…different ballgame.
I've hunted on the same place,and leased from the same man for 12-13 years..No contract,no insurance,nothing…He buys a lease tag from tp&w every year,and I figure out a way to pay him back for it (that was our deal,he buys the tag)..I'll always figure out a way to pay him for it,Replacing water lines to wells..fixing washed out rds etc…He wants to pay for the propane we use,and electricity…I pay him back in some way,because the man will not accept cash.
If his stock,which pays his bills ,tears up a $300 feeder…So be it,I'll fix it where they'll never get to it again.
I guess what I'm saying is,I try to make "me being there" the least of his worries.
Feeders,and ladders..Meh. Pop ups? The wind will tear em up if the cows don't…Just my .02 cents

Oh, i agree with yall. And no a cow aint gonna take off after a dog and try to kill him. Just had a guy whinin at the lease hat he was gonna make the landowner pay for all the stuff his cows tore up. I just laughed at him. We told him the same thing. Tough luck. Like it or leave it.

Yea. Land owner is not responsible for a hunter who put up a poor pen

Land owner is not resposible for damage done to your personal property. At least that's what is stated in my contract. My pens are built from hog panel and sturdy enough, that cows do not enter them. Had a cow come in to camp and break a mirror off my jeep. I in no way felt the need to ask the land owner to pay for it even if it wasn't stated in my contract. I just finished the mirror off.

I agree, cattle tearing stuff up is part of the deal. You want your stuff protected, then build a good pen.

The only time i've had to go to the land owner for anything is when he let cattle in without telling me and my pens were open and they ate all the protein out of two feeders. I asked him prior to let me know before he does this so I can secure them.

Owner is not responsible for damages his/her livestock does....our lease agreement states it is a working ranch with livestock on it. We take precautions for livestock....
