    Problems with Neighbors Septic System...

So we are about to start building in a neighborhood and I have a neighbor on one side that is established.

We are in the country so everyone has aerobic systems. This guys system sprays several times a day and his yard is wet all the time. Now is septic water is filling the ditch on the front side of my property as well pooling halfway down his fence and then at the back of his fence all of which adjoin my property.

On the other side of his property there is a large pool adjoining a friends lot.

I have talked to the guy thinking he had a leak. But I am sure that he is using too much water as we have found out there are about 8 people living there.

What should my next action be? The water in the front ditch is so bad we leave ruts driving thru it.

Septic water cannot run off your property can it?

    HELP!!!

Gota have a permit to even use a septic system. So yes I think report it. Not exactly sure to who.

Texas Commission on Environmental Quality (TCEQ) is the state regulatory authority. Most likely they have delegated power to your county or city, but that varies by area. I know there are regulations regarding the proximity to your lot versus the spraying of the septic water. Only seems right that they would regulate this water running off as well. Sounds like his dispersion method/area is grossly undersized for his usage. May want to talk to your builder and see who they are getting there permit from (city or county or state) and go from there.

Report it to your county health department. They approve septic systems and can take action on the offender.

You can report it even if you smell it...

Don't answer the door if he brings any vegetables over from the garden

                  This is the correct answer^^

edit.....in my county it's the Environmental Dept, they even have their own police officers that look for that sort of thing.

I have an aerobic system, too, and that state department is VERY strict on its maintenance and operation. I have to do an inspection and maintenance report every 4 months, and that includes replenishing the chlorine tablets, which disinfects the water coming from the sprayers. One requirement, however, is that there be sufficient vegetation (i.e., grass) in the spray field to absorb the water, not bare ground. If it's pooling somewhere, that could be a compliance issue. Septic compliance in Texas is by county, so call your county office.

I would think twice about building there. Too many people living there and already septic problems. Sounds like the making for bad neighbors

I have a buddy that took the septic police lightly and came home after work one day cracked a beer and before he finished it he was in the back of a police car. He said he didnt tell anyone in jail what he was in for.

Sounds pretty crappy to me. Sorry I couldn't resist. The whole process sounds nasty to me. Is there an odor?

I wouldn't build there...... You're already upset and you don't have a horse in the race

If the system was designed properly it can handle the load of what it was designed for, this case it's 8 people. Could be bigger problems like groundwater leaking into the tanks(all the rains recently in my area). There's probably more to it than his family whiz zing too much.
