How wide, and are they the same?

Two pics both take at same spot, 21 days apart. Are they the same buck and if so how wide do you think? My wife has yet to take a buck and she watched what se thinks is the taller racked deer tonight for a while, she was unsure if he was legal though. Thoughts....

I can't tell if they are the same bucks or not...too blurry and antlers always look different going away....

Don't think they are the same buck, I looked at the position of the brow tines, the second buck has the brow tines much closer to the bases, just my thoughts.

If you are refering to the 13" law in some counties the one on the left looks for sure over 13" and the other one looks at or over 13" also.
