    Please Read And Share {PSA}

    I have always heard in Texas that if a person refuses to go to the hospital they do not have to go. This is very wrong!!!

    Had a Captain in the FD explane to me the way it works.
    If the person can not answer simple questions - to the hospital.
    If the person can not walk across the room - to the hospital.
    If the person has had an accedent in their pants {just 1} - - to the hospital.

    EMS will call PD and they will say "Take Em"

            I'm not sure that's accurate. A person can sign out A.M.A. (Against Medical Advice) as long as they are mentally competent. That FD Captain might want to do some research.

              Someone that is not alert and oriented can be made to go. If you are alert and aware, you don't have to go. If a person exhibits certain behavioral issues, P.D. Can do an adult protective warrant to make them go. If you take someone against their will, its kidnapping.

                    Sounds like the information given is coming from someone making their own rules. A competent adult, meaning they are alert and oriented to person place time and event has the right to refuse anything they want, regardless of their physical condition. Now, if such person is a harm to himself or others, PD can get involved. But just because they can't walk across a room or just because they have an accident does not warrant automatic transport to the hospital without consent, and taking someone who is competent without evidence they are a harm to themselves or others is kidnapping.
