A couple of "game warden" questions

    A coupla questions here:

    1. Are you required to have a hunting license to kill nuisance animals on your own property? Say you're experiencing damage or predation from feral hogs or coyotes - like they're killing your livestock or something. Do you need a license to take them out?

    2. Are game wardens allowed to enter private property to check for a hunting license, bag limit, etc.? Say he's driving down the highway and sees somebody hunting in a pasture or stand on their private property... can he open the gate or climb over the fence to check it out?

      1. I think if your livestock is being harmed, no. Other than that, yes.
      2. A game warden can walk into your house when he wants to.

Pretty sure a game warden needs permission or probable cause to walk into your house.

            1) I believe it says in the hunting regulations handbook that you can shoot hogs without license if they are damaging your land/property. Coyotes I'm not sure. And if they're killing livestock I'm not sure.

            2) From what I know game wardens have more privilege than police when it comes to going on your property. Can pretty much do what they want without a warrant.

No they do not. All they need to "suspect" and they can enter.

Incorrect. Old wives tale. They need probable cause as does any other law enforcement.

LMAO! Who told you that. A game warden? They are just like any other peace officer and need a search warrant unless you give them permission. They can enter under exigent circumstances as any police officer can. They can go on your property where hunting and fishing is known to occur.

About 10 years ago I killed a armadillo and the game warden happened to be on the dirt road that my in laws lived on in Halletsville. I was holding the armadillo up as he came around the corner on the dirt road. He pulled through the gates as my MIL and him were and still do speak often. I went up to his Tahoe and we started talking (small talk I had never been approached by a GW at the time). He asked if I had a hunting license and I told him that I did not have it yet that mine had just expired. He said he could give me a ticket because I needed to have a hunting license even for a silly armadillo. I could not believe it because of coarse there is not a season for armadillos. I went and got one from Wal Mart the next day.

I have always thought this was a crazy law and never would have known unless he had not told me.

By the way he did not give me a ticket.

In other words if he sees blood, feathers, piece of hide etc. outside the residence he talk check it out. Or if he sees you in the field he can check your paperwork.

Not unless you give him permission. But that could be probable cause to get a search warrant.
