....folks often get public place, public property, private place & private property all mixed up. A place can be more than one of these or a combination thereof.
Bottom line, the from yard is good to go for. PI arrest if the officer can articulate that the person is intoxicated and is a danger to himself or another.

I was drinking in a backyard one time in college and an officer was allowed to come in. Most of the under-agers "ran for the hills" but me and a couple buddies stayed put in the backyard sitting in chairs by a keg as we had just got there from going to a movie. An officer came by and checked our IDs at about 12:40ish and told us to pour our beers out. The bars stay open until 2 or so and I was 23 at the time and thought it was kinda weird so I figured I would stand my ground. I felt I was perfectly legal plus it was like my first beer. He saw some other kids trying to sneak off so he caught up with them and cited them for PIs. A little after 1am he came back to us and asked why we hadn't left. We told him we were perfectly legal sitting in the backyard. He smiled and said OK and asked to see my license again. He then started filling out a ticket. I was like what is this for? He said there is an ordinance in College Station for Public Consumption After Hours (1am).
So you can still be in Public in the backyard if there is access to a large crowd I am guessing from TVCs explanation. I learned my lesson quick that day but don't really blame him too much. He has a hard job. But....A little discretion on both our parts probably would have went a long way.
