After interpreting Nebuchadnezzar's dream, Daniel was promoted to reign over Babylon. Upon his urging, Shadrach, Meshach and Abed-Nego were promoted also, but Daniel "sat in the king's gate."
When the heralds and scholars (by Neb's order) ordered the people of Babylon to worship the golden idol, Daniel wasn't present, so those three were the only ones who were found to be in disobedience of Nebuchadneezzar's orders... and thereby cast into the fiery furnace.
Or something like that.

but that is nothing to debate
scripture doesn't say
or he wasn't there at the time.
