Austin CHL Holder Shot By Police

    "By Ciara O'Rourke
    American-Statesman Staff
An Austin police officer tried to handcuff John Schaefer in the moments before the officer fatally shot Schaefer twice in the chest this month, according to an affidavit for a warrant to search Schaefer’s home."

Sounds like a clean shoot.....point a weapon at a officer and get what you desereve.

Headline is awfully misleading, the fact that he holds a CHL is really of no consequence. As a responsible gun owner it's your duty to understand where your right crosses the line into aggressive behavior.

That officer had every right to make the scenario as safe as possible, he also had every right to defend himself when mr Schaefer pointed his weapon at him.

Simple, point gun at officer, expect to be met with equal force

A CHL does NOT give a person a right to use a handgun, only to conceal it. A CHL holder must still be cognizant of the right to use that weapon depending on the circumstances.

While not passing judgement on whether the LEO had a right to shoot him, since I was not there, he would still be alive today if he had left the weapon in his home as requested to do.

Taught Gun Safety Classes. He needs to practice what he preached. Dont point a gun at anything you dont plan to kill. Cop did exactly what he should have. After asking the guy to put the gun down and felt fear for his life. 2 in the chest end of the story. Good Shoot in my books.

              Very misleading headline...

Don't point your weapon at an officer then you don't be dead...

I don't blame the cop for shooting him. But what I don't understand is why the cop saw it fit to disarm the guy on his own property. Seems kinda fishy but I don't have all of the details either. We may never fully know.

While i agree that you shouldnt expect anything less when pointing a weapon, at anybody, i feel we arent getting the whole story yet.

I also lean toward the idea that there are too many officers claiming the "If a peace officer reasonably believes a safety risk exists, the officer may disarm you."

Just because you have a gun, doesnt constitute a safety risk. And im just tired of hearing how just about every joe blow gets disarmed.

Plus the old guy was on his place so concealed or not, he was legal in carrying.
Dispatch has no authority to ask him to put his gun away, just as much as they cant ask him to paint his house blue. The law on disarming a chl holder is there for a reason, to protect officers if they reasonably believe they may be in danger.

Granted, we dont know if this old guy was acting cooky or what, but thats why i dont believe we have the full story. I personally know folks, law abiding, regular Joes who have been disarmed for no reason.

Poor old guy though. I wonder what prompted him to point it at the officer.

I agree with you 100%.....the whole disarming him, and why is my thought?

Henry have you read the statute on authority to disarm?

Sounds like police cover up to me. (tin foil hat activated)

Why was he going to put the guy in handcuffs. Sounds like the Leo had a power trip and the old guy didn't want to give in. Things escalated due to Leo wanting to establish dominance over the older guy, and probably showed disrespect, to the older guy in his own house.

My suspicions is that the Leo needlessly escalated the situation in what should have been nothing more than a the police begin to call in animal control to clean up a dead dog.
