    Wreck/Insurance Investigation ?

    I had a lady bust a U turn right in front of me on Friday. She swerved into the shoulder to swing wide for the U turn and I went into the median to try and avoid hitting her square on. She did not see me and kept on with the turn and I hit her in her door with my front passenger side. The cops show up and she told them that she was turning left. There was a dead end road there. I took a bunch of pictures and argued my case till I was blue in the face, but they said that because I made an illegal left maneuver (into the median) that I was at fault. I have been just beside myself with this whole thing. I asked the cops if I would have T boned her dead on in the lane we were in who would have been at fault. They said in that case it would have been her. They said because there was no evidence that she wasn't turning left then they had to believe her. I am going to give the pictures to my insurance and let them fight it, Has anyone ever been caught in the middle when the two insurances fight out a he said/she said situation?

    Wow!!! That stinks. Insurances will battle it out but it takes a while. If your agent is good they will push the claim through and go after her insurance. Hope they handle this quickly and painlessly for you.

            It just stinks all the way around. When I went to check on the lady she said "we can just exchange insurance and go (our vehicles were drivable) But I just knew she was at fault and I wanted a police report. I learned a few lessons for sure.

              I had that happen. Judge dismissed my ticket but insurance ended up splitting the cost.

                They told me that they do not investigate unless it was a fatality. Being that I was the vehicle in the rear and no witnesses that I get the ticket. I know they have a difficult job and get caught in the middle all the time. The lady did tell me that if I fought the ticket that she wouldn't show up.

                  Fight the ticket. Something similar happened to me in Florida several years ago. I went to court and won, which helped me with my insurance, my rate didn't increase and I didn't have to pay the ticket.

                      I've always been told never swerve left, always swerve right. Not necessarily easy to remember in the heat of the moment though.

                      I'd definitely fight it. It would seem hard for her to win if she's not there to defend herself.

                        Your insurance company will take your statement. Since you were ticketed that is the only eviedence they have to go on.That will hurt you. As far as her not showing up for court she doesn't have to. The officer gave you the ticket not her, she doesn't have to defend anything.

                          Yep. Been there, done that, got the t-shirt last year. No one recieved a ticket in the accident. Both insurance companies paid to fix their own insured's vehicle, minus deductible. As far as I know, that's as far as it has went (or will go). I'm out $1k for deductible for a lady trying to beat a yellow light. And conveniently, the camera's at the intersection weren't functioning, so no video. He said, she said.

                            Yeah, you need to believe her about not showing up, she wouldn't lie. You know, like she didn't lie about turning left.

                              Let insurance settle it. The insurance companies use the police report as a part of the process, not to settle the claim. Make sure you give them all your photos.
