      If you knew that there was a fine and you didn't get to keep the deer if you screwed up, then I see no problem. You screwed up and paid the price.

      If I had a guest on my lease that shot a deer that they weren't supposed to, they wouldn't keep the deer either. They would also be asked to leave and would never be invited back. I can't see rewarding someone for doing something they weren't supposed to do. If you had waited for a clear shot at the 190, you could have missed with no problems. The 145 will do the ranch no good, but why let you be rewarded for YOUR mistake. If I knew there was that kind of penalty to pay if I screwed up, then you can bet your life I'd not take ANY chance on it happening. I bet if you had wounded the 190, you'd have had to pay for it even if it wasn't recovered.

      If I shoot one of the protected deer on the Junco, you can bet I wouldn't be allowed to keep it. There wouldn't be a fine, but my welcome there would end immediately. There's no excuse for shooting the wrong deer.

      When we guide, we sit with the hunter at all times. If there's a screw up, it's on us, not the hunter. No way would I allow a hunter to hunt by himself unless I KNEW him very well and how he'd handle himself in a big deer situation. Some people just become idiots when faced with a giant deer and lose all control. Those people will have me at their side to make sure they don't make a mistake.

        I brooker and some times guide package hunters on two different high fence ranches in Bosque county. The policies on both ranches do not let hunters sit by there selfs for that very reason. Some hunters that come in and are lucky enough to shoot there trophy early are offered the chance to harvest a doe or two also. Even then they are guided to make sure that something like your misfortune does not happen. And then if something similar was to happen, the fault then would fall back on the guide not the hunter.

        First thing I would like to know, did the ranch boss or lead guide let you hunt by your self for a top end trophy buck, I mean 190" buck would be top end ... right? The second thing is, did you know the penalty before hand for the miss happening?

        I guess if you were on a day type trophy hunt for a mature aged deer, like hunting the Lincon or the old "C" Ranch then the mistake would fall on you.

        Sorry to hear about your misfortune, $5,000.00 fine and no deer would make me start drinking ......... wait a minute, I do drink ...... oh, you know what I mean.

            Artistic, I don't think unclefish was saying you were off on your number. I think he was talking about your use of the words "market price" like these big deer are cattle or something.

                Big D I think at these prices, these deer are like cattle. So market price is a good term to use. Sorry about the 5K miss i guess. Hard to believe a hunting error costs more than my truck!!! All that for a jacket.

                    And even if it is how it went down, evidently it was a shot that should have never been taken because he had another deer behind him (the 145) that with a pass through you could have hit, injured, or killed even if your arrow found it's original mark.
                    This is either a ppile of bs or poor shot selection on your part.

                      WOW what a misfortunate accident. I would end up hurting myself let alone what my wife would do to me for spending $5k and comeing home empty handed with "the one that got away" stories....

                      Like the rest I would read the contract you signed carefully as I bet there is a legal way out of it if nothing else to at least get your deer. Wrong is Wrong but you should get more then just the memorie for $5K.
