Good luck Mike. Keep us posted on this one. You need to file a blue form if they didn't do an accident report. Go get pictures of his vehicle before they put it in the body shop. I would get the guys insurance info and start working on your repairs.

The insurance maybe a whole nother issue. Insurance is for accidents, not purposeful incidents. Usually there is an exclusion for damage done during an illegal activity.

bobo, based on the info given, I agree that the guy in this case should be arrested. What you don't want to happen is for the case to be dismissed and the jerk to get away with the crime because the cop didn't have the authority to arrest him!

I disagree with you on the rape example. Its unfortunate that you feel that way. Probable cause has to exist in ANY case for criminal prosecution. Just because a person claims foul don't make it so.

When I was young and my dad was in his prime, probably my age now a women accused him of rape, he had never talked to that women in his life. They arrested my dad took him out of the house in front of me like he was a piece of trash. Later that night he was released because "they had brought in the wrong guy" but in this case he was guilty and couldn't say anything to change their mind.

In the end the girl was charged for lieing she was never raped just had a grudge against my oldest sister.

It's ashame but it happens...
