    Updating my will

    Any Tomball / Spring / Cypress / Magnolia / N Houston folks have an attorney they like? I need to update my will.

    For simple, uncomplicated will I used Willmaker. On-line web-based. Super easy to do yourself,

        Tim, I'm going to recommend an attorney that I've used several times and been extremely happy with. Brock Benson (Grayson on TBH) is a helluva good guy and has always done me a great job. He's not local to us, but I've had no issues doing business with him via email, phone, Zoom, etc. If that interests you, PM him here, or text me and I'll share his contact with you.

          At what age would you consider having a will? We always had to have one when we deployed but I'm positive the last one I made back in 2009 has expired or needs to be changed if they don't expire.

            The last one you made is likely enforceable. You need to update it anytime your situation changes enough to justify it. Since 2009, have you gotten married, gotten divorced, had a child or two, accumulated assets, need to change beneficiary, need to change division of assets, etc.?

                  Look into setting up a trust instead of a will. Even though it will take a little more upfront work it will be better for anyone you might be leaving stuff too.

                    That being said Imo the type of trust needs to meet the special needs of the individual. And make sure you have a full understanding to the “T” before you put the assets in said trust. And I don’t claim to know the ins and outs of the different type of trusts out there.

                          I was told by an estate planner that if I put my primary residence into a trust and then sold it before I croaked, I would have to pay capital gains tax on the gain (26% total here in GA with Fed and State).

                          Make sure to ask questions.

                              I also recommend Brock. He has done my trust, and many other things for family, friends and I.
