    question for the lawmen out there

    This concerns speed limit signs blown down in Beryl. Background......Small town, headed south goin outta town. 30 mph posted until a cross street/ traffic light. Just past the traffic light used to be a posted increase to 40 mph. Sign blown away in the storm. Was 40 for about a mile until the city limit. Past that, 45 mph posted.that sign still present.
    Now... going north. Coming into the city limits was posted 40 mph after the CL sign. That sign is also missing.
    So, those of us who know, there should be a posted 40 mph speed limit along that stretch but the signs are gone. For those who don't know the area they would think the speed limit would be 30 mph from the traffic light til the city limits going south but 45 from the city limit until the traffic light headed north..
    What would a law enforcement officer do if they caught a person doing 45 in a spot where there used to be 40, or 30, or vice versa?

    i would think the court wouldn’t accept the violation with the storm damage to the signage.

      Whatever sign is post is what the limit is. Does not matter what it was. City’s change speed limits for various reasons. I know this was an act of nature but still, the last posted sign is 35 so it is 35 until the 45.

        Agree that whatever is posted is the law. Small town police who would write you for the 40 in the 35 is why people dislike the police. I don’t personally know one cop that would even consider that.

          That's what I've been thinking and practicing. But it's a minor inconvenience as I live on that road and travel into town every day. And it pizzes me off that they haven't replaced the signs after what? 3 months. The city is also lax in that there are vines climbing/ obscuring a lot of other signs around the area. What are they doin with the tax money we give 'em? Seems like it could be a traffic hazard! I have not complained yet but been thinking about it.

            My last speeding ticket was coming into three rivers from the south and I was day dreaming. That 45 to 30 change comes at you fast and I was going 48.

            Poor cop practically apologized the entire time for having to write the ticket. “Had you only been within 10 I could’ve gotten you a warning”
