    boat question

    the tag on my 12 footer says" 2 person or 300lbs" do the GW's inforce that tag or is it just a guide line to go by??

    They can actually ticket you if you overload it but most don't bother.

        my buddy is 6'9" and 340 lbs. he wants to go bow fishing. he alone fills that spot!

            Short answer- Yes - The sticker is placed on there by the manufacture because of federal regulations. The state does not have a statute that specifically addresses the max capacity plate by name, but a Game Warden can cite you for for Reckless or Negligent Operation under PWC 31.094 if you overload the vessel, and remember that the plate capacity is for ideal water conditions; in rough water you will want to be more conservative than what the plate states.

            Additionally, I believe, but am not a 100% sure that the US Coast Guard/Federal LE like Park Rangers can cite you specifically for exceeding the capacity plate, and yes they(USCG) occassionally patrol inland waters; I've seen them on Lake Amistad in the past.

                  There should be three numbers. One for horsepower. One for persons. And one for max capacity, including, motor, persons and gear.

                  Really the only time that would come into play is if you were caught or called in driving the boat recklessly.

                  JMO.
