come on, clearly he's being punished. he's not allowed to work. sure, he draws a paycheck, but I'm sure that's not why he has a job. Its the joy he gets from his work. The paycheck is merely an after thought. Seems to me if you have enough evidence to indict then you have enough to terminate employment. Could be wrong though. To argue both sides, I guess he could file a wrongful termination suit against them if he is found innocent of all charges.
Edit: both TexMax and Snipe beat me to the innocent part.

I understand the innocent until proven guilty part, but why pay him? Keep him on the employment roll, and pay him after the fact if indeed he is found innocent. Then you dont have to worry about not getting it back if he is sitting in jail. And even if he is found innocent, there is a considerably greater than zero chance he will retire from that position, and more than likely get what ever benefit package he is eligible for.
Is there any one I can get paid from for 7 months while being investigated by the DOJ?? Would your company do that for you?!?!?!

It's less expensive to continue to pay him until he's found guilty. If he was to be terminated immediately and then found "Not Guilty" he could file wrongful terminate suite and would win.
So whats worse, keep paying him a couple of thousand dollars or the possibility of having to lawyer up and it costing you tens of thousands of dollars?

Couple of thousand dollars per week. not for 7 months. and unpaid administrative leave has got to be an option during an investigation. Happens for lower ranking positions, when HR investigates sexual misconduct claims between employees. Not DOJ investigations of Directors for a whole state.
You can always pay him his back pay if he is found not guilty right?

I'm certain that (if innocent) the man would much rather be waking up and going to work than spending time in court and being toted around in handcuffs

This is not about his guilt or innocence. It is about if he should or should not be getting paid a full salary while a federal felonious investigation is under way. The man is performing no duties relevant to his position, nor is he on vacation, using his earned time off. He was not in cuffs until yesterday when he was arrested and arraigned for the pending charges. Until then he was as free as any other man, getting paid a fairly large sum of money to watch Oprah and Ellen.
IMO he should have been suspended like any other wahoo, WITHOUT pay, until the investigation, arrests and trials were complete, then paid any owed monies pending the outcome of the trial. Simple.
Would you company do that for you?? Put you on paid leave while you were under federal investigation?? If your answer is NO then why should he be getting paid from a Government that is already broke??
