    A bit upset

I have some land in Sasche that we planed on dove hunting this year, and I made all the calls to make sure that we could hunt it. The state laws says that we can, but you also have to follow the city code also. So I made the call to the game warden,he said we could hunt there as long as the city said we could. So I called the city sec. And he said that they follow the state law of hunting in the city limits. After talking to him, he thought that I should called the police chief just to let him know that we would be out hunt. Well I called the police chief and left a message explaining my self. So today I got a call back from the police chief saying that he talk to the city attorney and said " that we should not hunt out there".

My question is, if it's legal to hunt both by the state and the city , why is the police chief telling me that I can hunt this property ?

Cuz the police chief dont want to deal with it!

Pure lazyness. Its easier saying No... and not fielding phone calls about it.

Not an attorney..but "Should not" doesn't carry the same legal weight as "could not".
Why not call the city attorney yourself?

IMO if you find the statues about discharging firearms in Sache, and the laws about legally hunting, you should be able to regardless of what the Chief says.

If there is not a law on the books, then he can't just make on up, nor can the city attorney. You do have the law on your side provided there is no city ordinance against discharging firearms.

You probably should check the city ordinances or at least check with city atty. City secretary may or may not be familiar. City Atty should be able to advise. Since I don't live in Sasche, I'm not familiar with their ordinances but I'd almost bet there is an ordinance prohibiting discharging a firearm in the city.

              Hunt it...

Tell the city attorney and police chief that Charles from Wylie said it's o.k.

i used to dove hunt over in murphy next to the 4h building. there was a church on one corner and houses being built all around. it was a little 40 acre tract and we had the law called on us every single day we were out there. they would show up, and meet the caller their and show them on the map that it was legal.

Same here! Tell them Waylan from Wylie said it's o.k. On second thought that might not be a good idea.

Print out the relevant state laws and city ordinances, show up at city hall, and make the city attorney show you why you CAN'T hunt there, not why you "shouldn't."

"Should not" is not a "can't." Apparently, I would think there is no city ordinanace for discharging of firearms, since the chief didn't cite one or say anything about it. His job is to enforce the laws, guess there's not one there or he just doesn't know it.

I'm glad you noticed the smiley face and interrupted as being I'm full of crap"!

I believe the reason you can't is the discharging firearms in the city limits.

I used to hunt the field in front of the landfill on 544 years ago with zero problems. Matter of fact many times Wylie Police would stop by and ask how s the birds flying. One year we were out there and PoPo drove up and said no more hunting allowed. He said they were getting all kinds of complaints and top brass said to give anybody one warning. If caught after the one warning it would be an automatic trip to jail and fines. I heeded the warning and never went back, which totally sucked cause it was a few minutes from the house, free and was loaded with birds.

Still is loaded with birds too. Now they have signs all around saying "no hunting, no trespassing".
