    Question for LEO

    If someone doesn't have a CHL and they get pulled over do they tell the LEO that they have a gun? Or should they wait until asked?

    Not a LEO, but it's my understanding you dont "have to" disclose unless asked, but my opinion would be that it's in your best interest...


    now that DOESN'T mean yell "I GOT A GUN" when he approaches your car door..

        Much safer and cordial if all parties remain calm. "finding" a gun tends to move some people out of the calm realm.

          The law says that you don't have to declare it. I wouldn't bother telling an officer that I have one unless he asks to search my vehicle.

            I wouldn't bring it up unless asked, or...as indicated above...the officer wants to search the car.

                    I have a chl...it is advised when getting pulled over to hand the officer your chl along with your DL. I would think it might be to your advantage to make it known, if it turns into a search you want to make sure you have provided full disclosure so that it does not seem like you were hiding something.

                      edit: my bad..forgot the law was changed.. you are no longer required to..but be prepared for him to ask you why you didn't declare it when he runs your license..

                        Don't ask, don't tell. That's as much my right as having the gun. If that makes it 'seem like' I'm hiding something after the fact they're welcome to run all the #'s they want. I've done nothing wrong.

                              And tell him/her that "The law says that I do not have to declare to you that I have a firearm. I am not a felon, not in the act of committing a felony, and the gun is concealed. That is all that is required in the State of Texas". Now, expect a ticket, but heck, he/she was probably going to give you one anyway, especially if he is going to ask why you didnt declare that you have a concealed firearm.

                              Just my opinion, and I have never had an LEO ask me if I had a concealed firearm in the car or truck, and there is always one in there.
