    I am self employed, own my own company, so ya coverage is not fun to get. I just found that language in my policy book and you are correct system, "Eligible dependent means : Your spouse."

    SO unless there is a loophole in the state family code, she may be on her own very soon

      If you keep her on, and she uses it, and your marital status has changed, you could be dropped from coverage all together, and since you are most likely (like most divorced dad's in Texas) responsible to provide insurance for your kids as the court commanded.. you would be in for a HUGE shock monetarily on trying to obtain this without your employer...
      You are correct, i mis-understood my HR Director. She can take COBRA through your employer. IF your company has more than 20 employees, she can stay on COBRA under you for 3 years.

        Former fraud investigator - your gut and principles serve you well. She needs to be off the policy and provided option of Cobra. The Texas Department of Insurance has much bigger fish to fry but as someone else stated when this was ultimately discovered - which it would be in time - someone would want the money back they spent on the ex (ie - Insurance Company and your employer.)Monetarily it would be a huge payback.

            I'm an agent (as well as Howard and a couple other TBHers...), but not sure if my opinion matters.... the ex needs her own policy.

            I would call your agent first thing in the morning and get the ball rolling- don't let the agent drag his feet.

            Go with your gut feeling on this one...
