Workmans comp ?

    Workmans comp ?

    I work for a living on jet engines and yesterday a hyd lift that we use to get us up high enough to take these babies apart broke a bearing and the stand collasped. I've already lost 3 disc in my lower back so yesterday didn't help me at all. My question is when you get hurt at work do you get paid for the time you miss to go to the company doctor and therpy for the next week. My supervisor informed me that I have to change all my appts for after hours because I'm not going to get paid for time lost. Is this per workmans comp or a contract the company signed ( NOVA ). Thanks guys !

    I am not an expert on this, but I would think that you should be paid thru workmans comp while out with an injury sustained at work. Again I am not anyway an expert, but when I dislocated my shoulder at work I was paid thru the time I had to get well.

      Underthe workers comp laws you can schedule your appointments during work hours and have the absolute right to go to any doctor your want to. I would also check into your short term and longterm disability insurance as well.

      Workers comp law will take care of you for up to 6 months 180 days at that point they will determine the imparment rating and will offer you a settlement based on the degree of impairment that was caused by the injury..

      May consider getting an attorney to investigate why the equipment failed.. poor maintenance, no maintenance, has the malfunction or lack of been reported before on a daily inspection report??

      These are just a few things to consider..

      The Workers Comp has a obudsman hot line that you can contact as well..

      What ever you do. follow the doctors orders and do not do not do anything outside of his care, lets say it will void your warranty" The insurance group may decide to place a Private investigator on your case and will take pictures of you while you are at home and out driving around.

        I'd call your company HR department immediately and start filing the paperwork for an OTJ injury. Then ask about doctor visits and workmans comp procedures. I'm sure it varies state to state but it's serious here.

        If it's serious contacting a lawyer who specializes in it's a good idea.

          It depends. It has been a while since I dealt with Texas WC therefore my info may be dated, so you might call the insurance company adjuster to get the correct answer.

          I think, if your company is insured with a true workers comp insurance policy, your time off would be compensated through workers comp at a percent of wages not earned. You will not get full pay for the time off but may get some compensation for the time off to go to doctor or PT. I would not count on much.

          If your company is a non-subscriber to workers comp (which is legal in Texas), the company can pay you what every they want or not pay you at all.

            i do this for a profession in LA and have handled some cases in TX (Vocational Rehabilitation Counselor)

            i have no clue how your company contract reads , that would have to be discussed in detail with the HR personnel. Are you union , or contract labor ?

            I ALWAYS encourage the insured to work with the injured employee to keep things civil . I support the injured worker in attending dr. appt's and following thru with all medical treatment recomended (PT, LESI, Diagnostic testing, etc...)

            are you able to perform your job at full duty, with no restrictions ?

            does your employer have modified light duty ?

            have you missed any work, or been taken off work by your treating physician ?

              if you haven't visited a doctor, think about this before you do...sometimes visiting your own doctor (assuming you are insured) is much better than visiting the insurance companies workmen's comp doctor...your doctor has YOUR best interests in mind...the WC doctor does not....once you see the WC doctor, your doctor generally won't touch you, seen way too many co workers get injuries and get very poor medical help from WC doctors..just my .02

                I was on workers comp. Workers comp paid me 40 hours a week until I was able to go back to work. When I took off work for follow up appointments I was paid. If you go over 35 miles for rehab they will compensate you. ( I think 35 miles is correct)
                This should not cost you a dime.

                  That may be the case on this they did say they changed providers so I may be out for my p.t. and doc's visit. The cause of the accdient was a bearing failure They replaced the bearings 18 months ago and no pm was done during that time. Bearing were ground down .030 undersized thus the failure going to weigh my options on what to do now.

                    I had to go to the closest doctor they had that handled my type of injury.

                      my opinion is that a company has a duty to keep its employees safe in the work environment. If the required PM was not done, and the equipment was outside the specs required as a direct result of the lack of PM then I think there is negligence on the part of the employer. You did nothing wrong, you performed your job - the company did not. You suffered as a result of that. I would think that OSHA may frown on that operational behavior. I'm not big on the "sue the pants off of them" bandwagon, but I think in this case if you cant get any resolution that you should seek legal counsel. They should pay for your doctor visits and any diagnostic tests/physical and occupational therapy that you need to return to a 100% work status.

                        I'm still working just on light duty til they release me I was injured before about 7 years ago and they said it was degenertive condition but it didn't hurt before then. This lates incident they say it agravated it again so I'm trhinking that They will weasle out on this somehow.

                          Listen to Cajun Blake please...work with your employer to see the extent of your injury.

                          Speaking as a construction company owner who fears and loathes workers compensation injuries I will say this...if you are hurt then your employer wants you to get better as quickly as possible so that you can go back to work asap.

                          Sounds like your employer uses Nova Medical which is who we use and they are a legitimate medical corporation with chains throughout the state. Your employer will ask you to go to NOVA so that they can diagnose you and then make a suggestion for further care or send you to a specialist. They want you to go to their place first because it is reputable and they want to avoid more corruption of the system which has become so rampant.

                            Careful... You can't always select any doctor. Your work comp could be utilizing a provider network...most likely they are.
