    Legal Question

    One of my old neighbors went out yesterday and parked his truck close to the highway. He started walking to his stand, looked to his right and saw an 8 point standing there. He shot it with his bow and it took off running towards the road. While crossing the road the deer gets hit by a car and dies on the side of the road. Can he legally tag the deer at that time and take it home or does he have to call a game warden and see if he can get permission to take the deer since it was hit by a car? Or, does the deer belong to the person who killed it with the car if the game warden agrees to release the deer?

    The deer definitely does NOT belong to the guy who hit it with the car.

    I think the regulation governing this actually says you can't keep any part of a deer that has been struck by a motor vehicle, but I bet the game warden would make an exception in this case (for the hunter).

      And if he tags the deer, claiming it as "his," is he then liable for the damage to the car that "his" deer caused?

              Tag the deer and take it home. Tell the guy to call his insurance company to fix his car. He was traveling at a unsafe speed. If he was traveling at a safe speed he would of been able to stop, so it was his fault he hit the deer.
