    Property damage via auto accident question.

    As I sit in my driveway at 4a.m. waiting on DPS I have a question.

    When your property (fence) is damaged in an auto accident what insurance is responsible? The drivers auto insurance or my home owners?

    Just pulled up in the driveway and noticed half of my fence out in the road. Drove down the road and found the vehicle responsible for the damage without a driver. I hope they are ok.

    It is kind if chilly tonight they could have been collecting firewood.

      Ouch! I'm not an insurance agent (I just play one on the internet) but I think their insurance should cover it.

      I know a guy that wrecked his parents car when he was younger and tore up some fence. His parents insurance had to pay for it.

        I hope it turns out well for you. If the owner of the vehicle did the damage, should be their insurance that covers all damage.

        Now... since, no driver... you could get the story of unauthorized use / stolen. Thus, possibly no coverage.

              We had a neighbor kid run into another neighbors yard and knock down the fence, and hit a big oak tree. The neighbor chained the truck to the tree until the insurance paid up.

                  Well, long story short.............No Insurance

                  Not sure what my options are now. The trooper pretty much said I should go after the owner of the vehicle, due to the fact that he should have insurance on it, but does not.

                  Oh well, I'll deal with it after I get some sleep.

                    I knew that would be the case as soon as I started reading this thread. People that wreckless don't have insurance. Was a field sobriety test done on the driver?

                      The driver hasn't actually been located yet. The trooper just ran the vehicle and owner, no insurance on the vehicle.

                      The driver was apparently the owner's common law wife and her friend were in the car. They are mysteriously missing at the moment. The trooper is doing what he can to locate them, so we shall see.

                        I ran over a La-Z-Boy that fell out of a borrowed truck. Truck owner, not the driver is responsible for damages. Truck owner told me to go "Do" myself in not-so-kind words. Glad I carry collision. Your homeowners should cover if you want to go that route. Sorry to hear about your troubles.

                          If no insurance take to Small Claims court get judgment file that judgment with DPS who will suspend their license until paid. Not the best but it does work.

                            I was thinking the same thing as far as small claims. It is a pain, but worth it even if it is just for the principle of the matter.

                              In Texas The person driving the vehicle is responsible for having their own insurance..
