      it isn't trespass if not fenced or sign posted...maybe being in the city limits changes that??

          since it's a migratory bird and does this make it a federal offense?

            It was fenced just the gate was open. Wasnt marked in purple or posted. I dont think they will be filed on for trespassing by Penal Code definition but the Wildlife Code is very different. You throw a shotgun and hunting in the mix and it is some type a Class A trespassing from the sounds of it before I left.

                what is really overlooked is the game wardens that did the job. thanks to them, its up to the court to give out the fine.

                  That is one of the reasons I love living out west. Millions of acres to hunt and thousands of animals running free to be hunted. I hunt dove, quail, turkey, deer, elk, lion, every year . Iam at least 70% successful on the big game animals and more on the birds. No feeders to put out /fill and no worrieing about trespassing on some others fellows land. Not to mention in AZ. I get to carry my weapon day or night open or concealed.

                    I personally consider (from a wing shooters perspective) an open gate still a 'fenced' property. Signs shouldn't matter at that point...pretty brazen move.
