    Question for the LEO's

    Is it legal or not to ride a 4 wheeler in the ditch to the store?

    I am no LEO but I believe it's not legal!!!

      if you are riding in the ROW, then you better be street legal or get a ticket.

      and no I'm no LEO, but I am 99.9% sure about that.

        Years ago, I got four tickets(at the same time) for riding up to the store on a 4wheeler to get live bait at Lake Whitney. The HiPo told me that the road way is between the fences.

          actually the roadway is a set distance from the center of the road both directions.

          Generally, land owners put their fences on the line but some do not.

            Sec. 541.302. TRAFFIC AREAS. In this subtitle:

            (5) "Highway or street" means the width between the boundary lines of a publicly maintained way any part of which is open to the public for vehicular travel.

                      I know we had a lot of lease members ticketed by DPS on Hwy 12 in Mauriceville after Rita hit the area. All the trails were covered in trees and it was far too much work to clear them all and we had a few guys using the parking area inside the lease and then travelling down the ditches to their access point from the roadway. The ditch was 40' from the side of the roadway and they got tickets for riding down a roadway.

                      Around here, the SO seems to ignore the issue but DPS enforces the law.

                          For 18 years my family rode four wheelers from our house to our property gate that was about 3/4 mile away. Never got a ticket, however that doesn't make it legal just convenient. Now we've purchased some additional property that connects the house area to the other property so no need to ride along HWY 21.

                            I rode along the ditches for as long as I can remember as a kid. Passed many a DPS who never bothered with it as long as you weren't acting a fool. I would make the several mile trek to my grandads almost daily after school, ride to the ballpark for practice, even to school a time or 2.

                            But, in todays money driven economy and the need to generate revenue, common sense as gone out the window at times. They have to make at least their 3 "contacts" per hour, since quotas are illegal and those "contacts" can end in either a written warning or citation!!!!
