    I asked a friend that is in the Repo Business (10 yrs) and these are his exact words.

    "Send a 10 day cure letter certified to pay it current or bring it back at that point report it stollen and go repo it. Hope they keep keys"

    He was saying, hop you kept a key. You can get it rekeyed but it will cost ya.

      Can he report it stolen eventhough the title is in her name? Its not really stolen, just behind on payments. The title shouldnt have been changed to her name if she owed money on it, I think it makes this situation a little more difficult. Good luck, I hope you get it back.

        If you have a set of keys ( I would have kept a set for just this kind of thing) go get it.

        I don't know if it is leagl or not but I would get the truck in my possesion before she could do something to it.

        I bet you didn't mke her keep an insurance policy naming you as the lien holder either

          Dad and I had the same thing happen to us a few years ago, only difference was that we didn't change the title over, just left it in Dad's name until the guy paid it off. It was my first car, a 64 Mustang, that we kept after I upgraded so I could rebuild it later. We finally realized that the rebuild was never going to happen, so we decided to sell it to a local "mechanic" who had been asking about it for months. Anyway, he made a down payment, then did some repair work for my folks, and dad wrote some off the sale in return for the work, then the guy up and dissappears. We found out where he lived, and I went to go pick it up the next day, but the sonofagun had moved out during the night! We tried to report it stolen, but the detective said that it was a civil deal, and that we couldn't waste tax payer money investigating a "theft" that was really just a breach of contract. Went to the JP court and filed a suit in small claims court, the constable couldn't find him to serve him, so that was a moot point. Finally, we found a repo company that would pick the car up for about $300, but he was never able to find it. Luckily, the repo man didn't get paid until he delivered the car to our driveway, so he didn't get paid on that deal.

            I don't know if that would be legal, I'm sure he's going to have to do the same thing the bank does when they repo a car. But, this is what happened when my room mate took off in my truck, I was told that I could not file a police report since he had driven it in the past. I was told to mail a letter to his last known address (mine) telling him that he was no longer allowed to drive my truck, after 10 days I could report it stolen. Your situation is a little different as you would be the one "stealing" your own truck, but her name is on the title. You should contact a repo company and see what they suggest, I'm sure they are going to want to see a contract that she signed. I don't think they'll just go get the truck without one. For all they know you could have given her the truck then changed your mind or trying to pull a scam. Did you have any type of contract in writing?

              He is still the line holder on the title, it has not been completely signed over to her. She has only made one payment and if he sends the letter and she still doesn't pay it is considered stolen. My repo friend said sadly this happens a lot. If he reports it stolen and then repos it, when she (if she) calls the cops they will look at the report and she the line holder on the title reported it stolen and they will know exactly what happened and the cops will tell her sorry we cant do anything for ya.

                that why you send the letter and then report it stolen if she doesn't pay.

                  any updates? after reading some of the posts, it seems like since the truck is in her name you may not be able to repo it with documentation that she has not paid. Since she is not answering the phone she pretty much knows what you want is trying to avoid you so that she does not have to pay. any updates?

                    No updates as of yet. I agree it may not look good on my end w/o any documentation. I will see and will for sure get back here with what I find out. Probably will just have to chalk it up as a live and learn factor but we will see. Thanks for all the help....................Allen

                      How much is the truck worth? It may be easiest to just write it off as a loss on your taxes (loss or a theft?) and get some of the money back (I'm not a CPA or qualifed to offer tax advise) and be done with it. You may go through a whole bunch of expense and headache and have a truck worth a couple hundred bucks sitting in your driveway. I know it would let her get away with something you don't want to, but it may be the easiest thing.
