One of the things you need to remember is that if you are "arrested" you still have issues with remedy of the arrest if there is no complaint filed. Meaning, you will have an arrest of what I am guessing will be equivalent to a Disorderly Conduct arrest and you will need to expunge that arrest. If you are in the crowd you can get this done fairly cheap, but if you are not, and need to hire an attorney (that is not your fishing/hunting partner) then you will be out about $1500 plus filing fees.

My point is, for the hastle of going to jail, having to bond, and waiting to see if the complaint is filed by the State of Texas; then possibly paying another $1500+ in the expunction process............

Actually until September 1995 you could not have a handgun in public in Texas (other than exemptions such as shooting range, shooting sports, etc.) and there was no CHL to be had. You have more rights and authority to carry now than you did 20 years ago. Then the state recently added the law that for the first time in modern history made a person able to carry a handgun in a vehicle without the need for a CHL.

Until about the mid-70's there were almost no mandatory "shall issue" CHL states in this country. Now a large majority of states are in the "shall issue" a CHL to citizens and many states recognize each others licenses. Again, you have more rights and legal authority to carry now than a few years ago.

The gun rights movement is gaining momentum, not going backwards. The opposition is growing stronger with the current administration but I don't know of any states that have repealed their CHL programs.

As much as I'd like to agree with this in principal, reality is a different thing. Facts are that we as members of this society have to deal with the repercussions of stupidity around us, including within legislative restrictions. Every time I hear someone say something like this, it strikes me as a kid sticking his fingers in his ears and yelling "LALALA I CANT HEEEAAARRR YOUUU"

Stick your head in the sand out of principal all you want, reality will bite you in the darriare while you're pretending words on a piece of paper mean anything to those who lord over us.

What is the big deal about open carry?? Why would seeing a gun on someone's hip cause someone to panic?? It's a gun not the plague. If the law was passed then everyone would expect to see a gun in the open.

Because people are stupid. They will believe anything they are told, if they either want it to be true, or fear that it just might be.
Reality is nothing, perception is everything. The mouse may have a right to eat the cheese, but the cat is going to kill and eat the mouse regardless.

Bottom line is that stupid irrational people let their irrational fear of inanimate objects skew their perception. Those of use without rose-colored glasses are left to deal with the results... unnecessary restriction.

You can open carry an "Unloaded" gun. You just can't have a magazine or a bullet chambered (Semi) on a revolver you just can't have any bullets in the gun. Once you put the magazine in the gun or load a round in the chamber is when you will get in serious trouble. Unless you have laws that allow you to open carry a "Loaded" gun

I brought that up before when you made a comment about the new proposed law in another thread. It does nothing to change existing law. Some people might find the wording easier to understand or better clarity as you say.

Like any law, it will depend on the circumstances and the decision of the officer at the scene. The officer only needs PC to make an arrest. Therefore under the current and new wording it will be best to try and keep the handgun from being seen. It will not mean that a person is guilty unless he intentionally showed the gun but it might make for some unpleasant detention and/or arrest until a decision is made farther up the line.
