    That sucks. So he blew less than the legal limit and was still arrested?

      Someone need to educate themselves and work on comprehension before posting. That was embarrassing… even for the CFB thread![emoji1787]

        Seriously though, how could the arresting officer justify it if he blew under the legal limit? This is why good criminal defense attorneys make bank!

          DWI is not just .08, you can be DWI on pills, weed, street drugs or a combination of all. .08 is the alcohol level that is presumed as intoxicated. You can be convicted of DWI with a .02

              IIRC you can still get a dui if you are less than 0.08. That’s where field sobriety tests, etc come in. 0.08 is there because you are automatically considered impaired above it. A functioning alcoholic could pass a field sobriety test at 0.16, doesn’t matter they are legally impaired. If you pop an ambien and drink two beers, you are probably impaired despite being under 0.08

              Weed in the car plus alcohol makes sense that you would get the dui.

              Kids do dumb **** and make mistakes. I nearly got tagged while on a boat during a bachelor party. Got lucky, have never pushed the line again. Hopefully Anais learns his lesson

                  Exactly. It's really not that hard to comprehend. Don't have to be above the legal limit to get arrested. All they have to do is say he is impaired whether its alcohol or the weed.

                    Tweet I saw….Aggie mod retweeted and claimed this is what he’s been told
                    As well

                    “Was also told by
                    sources close to the case are indicating all charges will be dismissed. Smith was not intoxicated and the passenger has claimed ownership of the marijuana
                    @AggieFootball

                    Smith led @AggieFootball in receiving yards and touchdowns last season.”

                      Outside View. Aggies defending this guy would 100% be throwing stones if it was a Longhorn. Longhorns throwing stones would probably be defending this player if it was one of their own. Therefor it's a wash

                          Outside view.... Tech would 100% be throwing stones if it was a Longhorn. And telling us how their facilities are arguably the best on mother Earth and the universe for that matter.

                          And for the record....I'm pretty sure all Longhorns here called Joshua Moore an idiot and said hasta la vista when he got caught with a similar pistol. I don't recall any Longhorn fan saying Moore was just a college kid being a college kid. But we did hear the Texas locker room was being lost because of it..

                            My favorite part of that tweet is charges will be dropped............led the Aggies in yards and touchdowns.

                            For the kids sake, I hope it gets dropped and he can hopefully learn from this lesson and move on. So many times a talent or opportunity is thrown away. He is an adult so I don't feel bad for him if it is as its his choice if they stick too.

                              Fact. Tech's football facilities will be larger and nicer than UT. But all jokes aside, at the end of the day, stones should be thrown bc that's what makes college sports awesome. Petty drama keeps college sports lively.
